GEORGIA 31623 9990 (912) 264.7365 June 14, 1988 RE: SAC Permit #187, Captain's Row, Tybee Island, Chatham County, Georgia. The Shore Assistance Committee at its June 14, 1988 meeting considered and approved your plans to construct two lagoon structures, The permit is conditioned as follows: 1. The project is to comply with all other Federal, State and local statutes, ordinances, and regulations, and the applicant is to obtain all licenses and permits prior to commencement of construction; specifically, the applicant is to obtain the State's revocable license; 2. The public shall maintain rights of ingress and egress on the foreshore area channelward of the proposed work; 3. A copy of the above conditions must he supplied to the person in charge of construction at the site; 4. The protective berm or low dune will be planted with dune grasses from commercial nurseries and /or the Soil Conservation Service Plant Materials Center in Americus. Staff will assist in selecting the plant materials. The berm and planted materials will be irrigated; 5. The footprint of the lagoons is to be staked and inspected by staff prior to Construction. Enclosed, you will find two (2) copies of the permit. One copy of the permit is to be posted at the site of the work immediately (within 24 hours) and for the duration of the construction activity. The other copy is to be held by you for your files and for inspection by any authorized persons. The expiration date for the permit is two (2) years from the date of issuance (Le., June 14, 1990 ). However, no construction may commence within the area of jurisdiction of the act until the expiration of thirty (30) days following the date of issuance (i.e., July 14, 1988). Mr. G. K. Please supply the contractor or the person in charge of construction with a copy of this permit letter. The lagoons will be constructed in a low dune swale in a dune field that has built up since the 1975 Federal /State sand renourishnaent. Lagoon A is proposed to be 200' long x 60' wide. It will be 320' landward of highwater mark. Lagoon B is kidney shaped, approx. 115' x 80' and 260' landward of highwater mark. Both lagoons will be 5' deep with side slopes of 4:1. BridweIl June 14, ] 988 Page 3 TERMS OF PERMIT (AMENDED) 1,(a) Commencement of Construction or Alteration 1, A permit granted by the Committee becomes final immediately upon issuance, but no construction or alteration may commence until the expiration of thirty (30) days following the date of the Committee meeting at which the application is approved, except as otherwise provided in #2, below; provided, however, that if a timely appeal is filed, no construction or alteration may commence until all administrative proceedings are terminated, except as otherwise provided in #2. below. This time period is provided to allow sufficient time for an aggrieved or adversely affected party to appeal a decision of the Committee. 2. If the Committee, either at the request of the applicant or on its own motion, finds that an emergency exists in any particular geographic area or in regard to any particular permit (s) issued by the Committee, the Committee is authorized to allow a permittee to commence immediately or to continue the construction or alteration authorized by the permit. The Committee in determining an emergency shall base its determination on imminent peril to the public health, safety or welfare, or a grave danger to life, real property, structures or shoreline engineering activities. If the Committee makes such a finding of an emergency, the permittee may commence immediately or continue the construction or alteration authorized by the permit, but such construction or alteration is undertaken at the risk to the permittee of an administrative or judicial order requiring the sand dunes, beaches and submerged shoreline lands to be returned to their condition prior to such construction or alteration_ (b) A permit granted by the Committee shall expire two (2) years after the date of issuance of the permit. This time limit may be extended for good cause upon a showing that all due efforts and diligence towards the completion of the project have been made. (c) All plans, documents, and materials contained in any application for a permit shall be made a part of said permit if granted, and conformance to such plans, documents, and materials shall be a condition of said permit. No change or deviation from any such plans, documents, and materials shall be permitted without the prior notification and approval of the Committee. On -site inspections may be conducted by representatives of the Committee. (d) Compliance with all other Federal, State and local statutes, ordinances, and regulations shall also be a condition of every permit issued by the Committee, (e) The Committee may condition any permit as necessary to carry out the provisions of the Act. A permit may be revoked for non - compliance or violation of the terms of the permit or for violation of these Rules and Regulations or the Act. Prior to such revocation, the Committee shall furnish the person holding the permit with written notice of the intention to revoke. 11 Transfer of Permit In the event of the sale, lease, rental or other conveyance of property for which a permit has been issued, the permit shall be transferred provided; (a) there is no other change in the original application; (b) the original permittee provides written notice of such conveyance to the Committee within thirty (30) days of the conveyance; and (c) the new owner or lessee provides within thirty (30) days of such conveyance, notification in writing to the Committee of his intent to abide by the terms and conditions of the permit, III Completion of Project Work.
