AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A MAJOR
AMENDMENT TO THE FINAL PUD PLAN FOR LOTS J AND K, SOUTHGATE SUBDIVISION,
SECTION TWO, LOTS XX AND WW SOUTHGATE SUBDIVISION, SECTION SIX AND LOTS 20,
21 AND 22, SOUTHGATE SUBDIVISION, REPLAT OF SECTION ONE, JEFFERSON CITY,
COLE COUNTY, MISSOURI, LOCATED IN THE 1200 BLOCK OF DUANE SWIFT PARKWAY.
WHEREAS, Sllverton Development, LLC, owner of the real estate hereinafter described, having
submitted to the City Council a Major Amendment to the Final PUD Plan of said real
estate, being located in Jefferson City, Cole County, Missouri, and more particularly
described as follows: Lots J and K, Southgate Subdivision, Section Two, Lots XX
and WW, Southgate Subdivision, Section Six, and Lots 20, 21 and 22, Southgate
Subdivision, Replat of Section One and is addressed as 1236-1242 Duane Swift
Parkway (Lots J and K) and 1241-1247 Duane Swift Parkway (Lots XX and WW)
and 1421-1427 Duane Swift Court (Lots 20 and 21) and 1424-1426 Duane Swift
Court(Lot 22); containing 3.95 acres.
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
• all matters been compiled with, as said property owners submitted to the Planning
and Zoning Commission and City Council a Major Amendment to the Final PUD
Plan for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Major Amendment to the Final PUD Plan submitted by Dustin Hoskins on
behalf of Sllverton Development, LLC, on file as Case No. P06011 in the Jefferson City Planning
Division Is hereby approved for the above land referenced herein.
SECTION 2. The following principal land uses are approved for the site: Two-unit attached
townhomes or single family detached residential use.
SECTION 3. Approval is made subject to the following conditions: (1) A single-family
attached townhome containing two dwelling units shall be permitted on each lot in the approximate
location shown on the amended Final PUD Site Plan. Instead of a two-unit attached townhome,
one single-family detached dwelling may be built on each lot in conformance with RS-2 district
regulations; (2) A parcel division or replat shall be approved for the relocation of any lot lines; (3)
Compliance with the recommendations and technical corrections of the Engineering Division.
SECTION 4. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.

SECTION 5. Access: Duane Swift Parkway is a local residential street with 60 feet of
right-of-way width and 34 feet of paving width. A street has been built in front of Lot WW and along
the east side of Lots 20 and 21 but no street has yet been built In front of the other lots, Including
Duane Swift Court, a cul-de-sac. This plan Includes completion of the missing section of street.
SECTION 6. This ordinance shall be in full force and effect from and after the date of Its
passage and approval.

Major Amendment to the Final PUD Plan
The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday, May 15,
2006 at 6:00 P.M. in the Council Chamber of the John G. Christy Municipal Building, 320 East
McCarty Street, to consider a Major Amendment to the Final PUD Plan for the tract described
herein:
Section 1. The subject property, containing 3.95 acres, is described as Lots J and K,
Southgate Subdivision, Section Two, Lots XX and WW, Southgate Subdivision, Section Six, and
Lots 20, 21 and 22, Southgate Subdivision, Replat of Section One, Jefferson City, Missouri and
Is addressed as 1236-1242 Duane Swift Parkway (Lots J and K) and 1241-1247 Duane Swift
Parkway(Lots XX and WW)and 1421-1427 Duane Swift Court (Lots 20 and 21)and 1424-1426
Duane Swift Court(Lot 22).
Section 2. The purpose of the public hearing is to hear an application for a Major
Amendment to a Final PUD Plan to change the allowed use of seven vacant lots currently
approved for single-family detached residential use to two-unit attached townhomes. The
application was filed by Dustin Hoskins, on behalf of Silverton Development, LLC, property
owner, and is zoned PUD Planned Unit Development. The complete application is on file as
Case No. P06011 and Is available for inspection during regular business hours at the
Department of Community Development, Planning Division, Room 120, John G. Christy
Municipal Building, 320 East McCarty Street, Jefferson City, Missouri.

The owner/developer proposes to change the lots to two unit attached townhomes
from single family. This will basically complete the development of the subdivision to
include the completion of construction for Duane Swift Parkway, which is important to
fire and police services.
There is no signing proposed. There is no anticipated site specific traffic impact
study required. Filing fees are attached.

Application filed by Dustin Hoskins on behalfof Silverton Development, LLC to amend a Final PUD
Plan by changing the pemtitted use of seven(7)vacant lots from singledamily residential to two-unit
attached townhomcs.

The subject property is located in the Duane Swift Parkway Townhomcs PUD.This development received
Final PUD Plan approval in 1999.The PUD Plan was last amended in Jnnuaty2006 when the permitted use
of six lots located immediately north of the subject property was changed from sing]e-familyresidential to
two-family attached townhomcs.
Nature of Request
The subject property consists of seven (7) vacant lots currently approved for single-family detached
residential use. The owner is requesting to change the allowed use to two-unit attached townhomcs. If
approved, the total number of dwelling units allowed on the seven lots would increase from 7 to 14.
• Surroundina Uses
Two single-family homes are located north ofthe subject property on Lots G and 1-1.Other lots to the north
and cast are zoned for and have been developed with two-family dwellings.Tltc area to the south and west
is zoned RS-2 Single-family and is developed with individual residences.
Staff Analysis
Access,Duane Swift Parkway is a local residential street with 60 feet ofright-of-way and 34 feet ofpaving.
A street has been built in front of Lot WW and along the cast side of Lots 20 and 21 but no street has yet
been built in front of lice other lots,a distance of approximately 450 feet excluding Duane Swill Court,a
cul-de-sac. This project would complete the missing section of this looped street.
TmMc. The estimated traffic from single family homes is 9.6 trips per unit vs. 5.9 trips per unit for
townhomcs or condominiums. If approved,total tmffrc from the 7 lots is estimated to increase from 67 to 82
trips per day.
Lot Size and Widtb. All lots have at least 12,000 sq. fl.of land area and 100 feel of width which exceeds
RD hvo-family residential standards of 6,000 sq. fl.and 60 feet of width.Minimum building setbacks will
be 10 feet for the side yard and 25 feet for the front and rear yard. The proposed site plan shows the
relocation of the south lot line of Lot J to the south about 30 feet to make lot J larger.The land would come
front Lot K which is fairly large. A parcel division or repiat would be needed for this lot line relocation.
Parki= The requirement for a two-family dwelling is 2 parking spaces per dwelling unit. Existing two-
family dwellings have generallymet this with a one-car garage plus one space in the driveway foreach unit.

Sidewalks. The subdivision was platted prior to the requirement for sidewalks and no sidewalks exist,
Utilities. Water, natural gas and electric lines can be extended to serve the lots. All lots can be served by
existing sanitary sewer lines.A fire hydrant is located in front of Lot E and Lot MM which is more than 300
feet.from some of the subject lots on the cul-de-sac.
Dminaee, Front lot,driveway and street drainage is provided by the curb and gultersystcm.There are a few
curb drainage inlets and underground stonn sewers within certain sections of the subdivision.The public
improvement plans would dctcmlinc the type of drainage structures needed for this section of the
development.
Discussion
The proposal would result in the construction of 7 additional two-family dwellings.Two-family dwellings
can either be built as duplexes(the lot and both units under single ownership with one or both units rented
out)or as single-familyattachcd townhomcs(units separated by a fire-resistant vertical party wall with cacti
unit individually owned). In January, the applicant stated that the intent of requesting Iwo-unit attached
townhomes is for the express purpose of providing for ownership and not rental of each unit. Restrictive
covenants would address such matters as the minimum square footage of each unit and materials used to
finish the exterior of the dwellings. In January, the applicant slated that the front and sides of the units
would consist of brick.
Staff Recommendation
Staff supports approval of the requested amendment,subject to the following conditions:
1. A single-family attached townhone containing two dwelling units shall be permitted on each lot in the
approximate location shown on the amended Final PUD Site Plan, Instead of two-unit allnohed
townhome, one single-family detached dwelling may be built on each lot in conformance with RS-2
district regulations.
2. A parcel division or replat shall be approved for the relocation of any lot lines.
3. Compliance with the recommendations and technical corrections of the Engineering Division.

COMMENTS:
The Engineering Division has done a technical review of the site plan as submitted by Central
Missouri Professional Services. The following comments are regarding this review;
Regarding infrastructure;
Streets-
Facilities have been previously proposed and approved. Street construction for this phase
will connect/complete Duane Swift Parkway.
Storm Water-
Facilities have been previously proposed and approved with street construction plans.
• Erosion Control-
Erosion control measures will need to be utilized during street construction and buildina
construction portions of this Moiect including a temporary granular entrance from each
end of street Silt fence and inlet protection will be needed with all phases of
construction.
Sidewalk-
Sidewalk has not been required previously in this subdivision.
Sanitary Sewer-
Facilities have been previously proposed and approved for sanitary sewer main access for
each lot within the subdivision.
Traffic Impact-
The proposed phase will complete the loop of Duane Swift Parkway, allowing residents
of the subdivision another route to go through the subdivision.
Fire Hvdrants-
Facilities have been previously proposed and approved with street construction plans.

Street Lights_
Facilities have NOT been previously proposed for this section of the subdivision. Street
light locations will need to be added to the previously approved street plans, and installed
�. in conjunction with street construction
ENGINEERING,STAFF POSITION:
Conditionally support, with any specific technical comments and requirements as underlined
above, to be addressed with revised improvement plans,prior to consideration of this case by the
City Council.
