It is understood that if this permit is granted the builder will at all times comply with the zoning, subdivision, flood control, building, fire,
soil and sedimentation, wetlands, marshlands protection and shore protection ordinances and codes whether local, state or federal, including

Based on Jonathan's email of November 8, 2010 responding to my email of November 8,
2010 with my letter attached, I am going to go ahead and advise McNamara that a building
permit can be issued for the fence to be constructed. In light of the time that has elapsed, I will
advise council that this is happening so that they will be aware. If either of you are aware of any
recent developments or controversy pertaining to this, please let me know.
Please confirm my understanding is correct also, although I realize there may be some
disagreement about the matter.

Site plan and /or architectural rendering of the proposed development depicting the location
of lot restrictions.
A survey of the property signed and stamped by a State of Georgia certified land surveyor.
That there are unique physical circumstances or conditions beyond that of surrounding
properties, including:

for the erection of a fence at #1 19th Street, Tybee Island, Georgia
31328.

EXPLANATION OF HARDSHIP

1. Because the property is adjacent to public beach access (19`h Street)
and the building being the first residence on the beachfront, many
people use the dunes for sunbathing, etc. With no restroom facilities
close by, the front side of the building is used instead. Many times we
have witnessed individuals urinating against the building and using
the building as a privacy area to change clothes. An erection of a
fence seaward of the building would prevent these individuals from
having access to this private area.
2. Sand is blowing over the dune field and accumulating against the
entrance doors which face the ocean. A fence would stop this as well,
increasing the existing dynamic dune field.
3. The property owners have two dogs. Since dogs are not allowed on
the beach or in the dune area and should not run free in a residential
neighborhood, we would like a fence to restrict the animals to the
owner's private yard.

Request is made for the erection of a stucco fence approximately 68
linear feet and 4 feet in height; seaward of the existing residence to match
the existing stucco fence along the property line on 19th Street. This fence
would encroach upon the Tybee Shore Protection Line by approximately 25
linear feet.
We also request an approximately 70 linear feet and 4 feet in height
white picket fence along the southern side property line. The picket fence
would encroach upon the Tybee Shore Protection Line by approximately 38
linear feet.
The total area of encroachment upon the Tybee Shore Protection Line
by the erection of the stucco fence and the picket fence would be
approximately 380 square feet.

North End Parks and Overlay, Mr. Brewer seconded. The motion carried with
Crone, Brewer, Doyle, Wolff and Smith voting in favor and Brown recused.
Mr. Crone moved to approve the recusal appeal for Mr. Brown to participate on the
South End Overlay Ordinance, Mr. Brewer seconded. The motion carried with
Crone, Brewer, Doyle, Wolff and Smith voting in favor and Brown recused.
Mr. Wolff moved to accept the recusal appeals for Brewer, Brown, Crone, Doyle and
Smith to allow their votes on the Shore Protection Ordinance because of its wide
applicability, Mr. Crone seconded. The vote was unanimous.
Public Hearings:
Mayor Buelterman opened the public hearing for a variance at 17 Logan Street for
Archie Lanier. Ms. Allen said Mr. Lanier is requesting his porch have a 15 foot setback
His front stairs will be at 10.8 feet. She said Planning Commission and staff
recommended denial. Mr. Bert Barrett said the lot is substandard and Mr. Lanier has
owned it for thirty seven years. Mr. Wolff said staff's determination was there was no
hardship. He asked why council was hearing this. Mr. Barrett said this is a lot of record
from 1919 and Mr. Lanier is not requesting to put a monstrosity on it. He said the house
is 1,050 square feet with a 300 square foot porch. Mr. Brown said it looks as though the
Setbacks would be in keeping with other houses on that street. Ms. Allen said staff
Looked at applying the 200 foot rule and he could have a setback decrease to 16.57 feet
and He would not need a variance. Ms. Allen said Mr. Lanier was not agreeable to
Applying the 200 foot rule because of already having purchased his house plans. Mr.
Hughes said the record should reflect that each Council member has the ordinances
before them that apply to public hearings as well as 5 -090 on variances and the
standards that council should take into account on this petition and the other petitions
tonight. Mr. Brewer moved to approve, Mr. Crone seconded. Mr. Wolff said he felt
they should not be approving this without a true hardship but he was in favor of
applying the 200 foot rule. Mr. Hughes explained for clarity that it is up to council to
determine what evidence of a hardship is adequate for the relief requested. He said there
is some element of discretion and judgment involved. The vote was Brewer, Crone,
Doyle, Brown and Smith in favor and Wolff opposed.

Mayor Buelterman opened the public hearing for a Shore Protection Variance at 1 & 3 19th
Street for Tom Waters in order to construct a fence.. Ms. Allen said the petitioner is
requesting to encroach thirty eight feet into the Shore Protection area. She said Planning
Commission and Staff recommended denial. Mr. Waters representing Dozier Cook and
Robert Chu said they are requesting to add onto their existing fence along the left side
and continuing on the ocean side and right side of the property. He said the fence across
the 19th side and front would be stucco with a white vinyl being used for the other side.
He said the fence is needed due to sand blowing and accumulating against the House on
the porch. He said the openness of the property has presented problems with People
using the property as a bathroom on 19th Street. Ms. Williams spoke in opposition to the
petition. Ms. Doyle moved to approve, Mr. Brewer seconded. The motion carried
with Doyle, Brewer and Brown voting in favor and Smith and Wolff voting in
opposition. Mr. Crone recused himself.

THIS DECLARATION OF COVENANTS AND RESTRICTIONS (the "Declaration') is

made effective the 1 / 'day of ,° , 2008, by the Mayor and Council of the
City of Tybee Island, Georgia ( "City"), a Georgia mwticipal corporation, which is the owner of
the real property described below in Section 1 ("Property"); and
WHEREAS, by resolution adopted by the Mayor and Council of the City, a certified copy
being attached hereto, it is the purpose of this Declaration to provide for the improvement of the
welfare of the citizens of the City, its property owners, and others who may use the ways and
areas served by the below - described property by establishing these covenants and conditions.
WITNESSETH:
1. THE PROPERTY TO WHICH THIS DECLARATION APPLIES: The covenants,
restrictions and provisions set forth below shall apply to the following Property located in
Chatham County, Georgia, in the City of Tybee Island (the "Property "), to wit:
The 5,290 square feet of Maritime Forest area on the property immediately
landward of the jurisdictional area and landward of the most landward structure as
described in Exhibit "A" hereto, will be maintained in a permanent conservation
easement in its current natural conditional and used only for passive recreation
and wildlife habitat and without any structures placed thereon, however, subject
to a right -of -access for adjoining and abutting property over the existing sixteen
foot access easement reflected on Exhibit A attached hereto.
2. RESTRICTIONS: The City, as a holder of title of the above - described Property,
does impose the following covenants to establish a conservation easement as provided and
permitted pursuant to Title 44, Chapter 10, Article 1, of the Official Code of Georgia, as being
covenants running with the and as follows:
The above - described Property shall be permanently used and maintained in its natural,
vegetative state with the exception of any existing, meandering foot path or such other area as
designated by the City, which shall remain available to the public for observing, bird watching,
walking and passive recreation and that no other uses shall be conducted or permitted in the
above -described area, except for the access easement usage of the abutting owner.
1 MANAGEMENT AND MAINTENANCE: The city shall be responsible for
maintaining the Property, including any path or walk, and all other acts and decisions with
respect to the property not inconsistent with these uses. The subject Property shall be managed
by the City of Tybee Island pursuant to such directions and by such persons as it establishes and
designates. Good and accepted ecological practices shall be employed to preserve the Property
in its natural condition.
4. RIGHT TO MODIFY: The sole right to modify or terminate these restrictions
and this Declaration only shall be in accordance with provision of O.C.G.A. § 44 -10-4.

Special Conditions
All permit conditions from Shore Protection Act Permit #350 and the Modification to
Permit #350 remain a part of this permit.
2. No construction or landscaping is permitted seaward of the DNR dune line as
indicated on the survey by Registered Engineer Mark Boswell, dated 6 -26 -2007.
Should the dunes shift landwards, which is considered a natural function of the sand
sharing system, every effort must be made to protect the dynamic area.
3. The native vegetatior;thin the dune system must remain in its natural condition toll
maintain habitat and function. Any incidental impacts to the area seaward of the DNR
dune line must be restored to its natural topographic and vegetative state.
4. During construction no materials or equipment can be stored in the dune area; silt
fence must be placed to clearly delineate the DNR dune line and the area seaward of
tha � l ine where no impacts at permitted.
5. Permittee must provide a post- construction survey. The survey must vie performe
surveyor registered in the State of Georgia and must comply with appropriate -
professional industry st dards.

property and just inside of the southern property line. The entire fence must be located landward

STANDARD PERMIT CONDITIONS
1. The project must comply, as applicable, for areas permitted herein, with all other Federal,
State, and local statutes, ordinances, and regulations, and the applicant must obtain all
licenses and permits prior to commencement of construction.
2. This permit does not resolve actual or potential disputes regarding ownership of or rights in
or over the property upon which the subject project is proposed, and shall not be construed as
recognizing or denying any such rights or interests.
3. All plans, documents, and materials contained in this permit application, required by the
Shore Protection Act O.C.G.A. 12 -5 -230 et. seq. are a part of this permit and conformance to
such plans, documents, and materials are a condition of this permit. No change or deviation
from these plans, documents, and materials shall be permitted without prior notification and
approval by the Department or Committee.
4. No further encroachment or construction shall take place within State jurisdiction, except as
permitted by the Shore Protection Committee. Any modification of the plans or structure in
the jurisdictional area must be reviewed and approved by the Department prior to
construction.
5. A construction placard will be required to be obtained from the Department up to 30 days
prior to the start of project construction and must be posted at the site. This placard will
include certain steps in the construction of the permitted project that must be approved by the
Department prior to construction.
6. The exact location and configuration of this project must be reviewed onsite and approved by
