HomeMy Public PortalAboutr 10-263e P alufra't, of J4 10 -263 No. Date of Adoptid rbV G'b r 18, 2010 RESOLUTION OF THE BOROUGH OF CARTERET, IN THE COUNTY OF i•IEDDLESEX DESIGNATING THE CARTERET REDEVELOPMENT AGENCY AS THE REDEVELOPMENT ENTITY TO IDIPLEAUTNT REDEVELOPMENT PLANS FOR THE MIDDLESEX AVENUE REDEVELOPMENT AREA, WEST CARTERET COl\IMERCIAL REDEVELOPMENT AREA AND WATERFRONT REDEVELOPMENT AREA WHEREAS, the governing body of the Borough of Carteret (the `Borough ") is authorized, under the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -I et seq. (the "Redevelopment Law"), to determine whether certain properties located within the Borough are in need of redevelopment; and «'HEREAS, the Borough Council of the Borough (the `Borough Council ") previously adopted a resolution designating all of the properties within Block 372 on the Borough's tax map as an area in need of redevelopment (the "West Carteret Commercial Redevelopment Area "); and `VREREAS, the Borough Council adopted an ordinance approving a redevelopment plan for the West Carteret Commercial Redevelopment Area (the `Ifrest Carteret Commercial Redevelopment Plan"); and WIdEREAS, the Borough Council previously adopted a resolution conditionally designating Butter Construction Co. as redeveloper of the portion of the West Carteret Commercial Redevelopment Area consisting of Block 372, Lots 7.02, S & 9 (the " hMemoes Project Site "); and WHEREAS, on October _, 2010, the Borough and Memoes, LLC ( "Memoes ", an affiliate of Butter Construction Co.), entered into a redevelopment agreement for the Menaces Project Site (the "Memoes Redevelopment Agreement "); and WHEREAS, the Borough Council previously adopted a resolution designating the properties known as Block 242, Lots 1, 2, 3 & 5 on the Borough's tax map (the "Middlesex Avenue Redevelopment Area ") as an area in need of redevelopment under the Redevelopment Law; and WHEREAS, the Borough Council previously adopted an ordinance approving a redevelopment plan for the Middlesex Avenue Redevelopment Area, along with amendments thereto (as amended, the "Middlesex Avenue Redevelopment Plan"); and WHEREAS, on September 9, 2010, the Borough Council adopted a resolution conditionally designating Ne%%gnan's Refrigerated Services, Inc. ( "Nevrnan") as the redeveloper of a portion of Block 242, Lot I (the "Newman Project Site "); and WHEREAS, on October 7, 2010, the Borough Council adopted a resolution conditionally designating Middlesex Food Stores, LLC ( "\Middlesex Food Stores ") as the redeveloper of a portion of Block 242, Lot 1 (the "Middlesex Food Stores Project Site "); and RTIEREAS, the Borough previously adopted a resolution designating the properties known as Block 4, Lots I, 2 (C.O. 100, C.O. 200, C.O. 300 and C.O. 400), 3 and 4, Block 5.1, Lois 1, 1.02, 1.03, 2, 5 and 6, Block 5.02, Lots 1.01, 1.02, 1.03 and 2.1, Block 6.1, Lot 1 and Block 6.2, Lot 12, and various parcels within Block 500 (collectively, the "Waterfront Redevelopment Area"), and WHEREAS, the Borough Council previously adopted an ordinance approving a redevelopment plan for the Waterfront Redevelopment Area, along with amendments thereto (as amended, the "Waterfront Redevelopment Plan "); and . l o-263 PACr of 3 - WHEREAS, the Carteret Redevelopment Agency ( "CARA ") was created and exists for the purpose of furthering redevelopment goals and policies of the Borough; and WHEREAS, pursuant to their respective powers under the Redevelopment Law, the Borough desires to designate CARA as the redevelopment entity to implement and carry out the Middlesex Avenue Redevelopment Plan, the Nest Carteret Commercial Redevelopment Plan and the Waterfront Redevelopment Plan, including by administering and carrying out the Memoes Redevelopment Agreement and any redevelopment agreements it may enter into with Middlesex Food Stores and Newman, and by identifying and selecting a redeveloper(s) to redevelop the remaining portions of the Middlesex Avenue Redevelopment Area, the West Carteret Commercial Redevelopment Area and the Waterfront Redevelopment Area, executing and administering redevelopment agreements with such redeveloper(s). NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED by the Mayor and Council of Borough of Carteret, in the County of Middlesex and the State of New Jersey, as follows: Section 1, The aforementioned recitals are incorporated herein as though fully set forth at length. Section 2. The Borough Council hereby designates CARA as the redevelopment entity to implement and carry out the Nfiddlesex Avenue Redevelopment Plan, the West Carteret Commercial Redevelopment Plan and the Waterfront Redevelopment Plan, including by administering and carrying out the Menaces Redevelopment Agreement and any redevelopment agreements it may enter into with Middlesex Food Stores and Newman, and by identifying and selecting a redeveloper(s) to redevelop the remaining portions of the Middlesex Avenue Redevelopment Area, the West Carteret Commercial Redevelopment Area and the Waterfront Redevelopment Area, executing and administering redevelopment agreements with such redeveloper(s). NO. 1C-2o3 eACe of 3 Section 3. If any part of this Resolution shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Resolution. Section 4. A copy of this Resolution shall be available for public inspection at the offices of the Borough Clerk. Section 5. This Resolution shall take effect immediately. Section b. Upon the adoption hereof, the Borough Clerk is directed to forward a certified copy of this resolution to the Executive Director of the Carteret Redevelopment Agency - Redevelopment Counsel and Special , Kevin P. MCManimon, - Esq., 400, non & Scotland, L.L.C. 1037 Raymond Boulevard, Suite 400, Newark, New Jersey 01702.
