ORDINANCE NO. M061 -1
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATIONS OF REAL PROPERTY CONTIGUOUS TO, AND LYING
SOUTHEASTERLY OF THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON,
MISSOURI, LOCATED IN SECTION 22, IN TOWNSHIP 44, RANGE 11 IN THE COUNTY OF
COLE, STATE OF MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY
OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE
NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson
desires to annex the unincorporated area of land described in Section 1; and
WHEREAS, the owners of the property have submitted a petition to have their property Included
within the corporate boundaries of the City of Jefferson; and
WHEREAS, the property is adjacent to the City and is located along Highway 50 and Cityview,
• and
WHEREAS, a public hearing concerning the annexation was advertised on April 28, 2006 in the
Jefferson City Post Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided by law,
the unincorporated area of land described as follows,containing approximate two regimental lots,
more or less:
Part of Section 22, Township 44, Range 11, Cole County, Missouri described as
follows:Beginning at the southwest corner of the Southeast Quarter of the Southeast Quarter
of said Section 22;thence running easterly 220 years;thence in a northwesterly direction to
a point that is 220 yards north of the point of beginning; thence southerly tot he point of
beginning.
Subject to and together with an easement for ingress and egress from U.S. Highway
50 to the above described property, said easement commencing on the south side of U.S.
Highway 50 at the location in the Southwest Quarter of the Southeast Quarter of Section 22,
Township 44, Range 11,where there is access to U.S. Highway 50;thence over and along
a strip of land 120 feet wide, lying on the right or south side of, parallel to and adjoining the
right of way line of U.S. Highway 50, as described in paragraph 18.40 of Report of
Commissioners of record In Book 169, Page 8, Cole County Recorder's Office, and being
. across part of LePage's Subdivision, per plat of record In Plat Book 6, Page 3, Cole County
Recorder's Office;and thence in a generally southerly direction over and along a strip of land
• 60 feet wide,the centerline of which is the centerline of an existing roadway to the properly
herein above described.

Quarter Section Line, 1177.82 feet to a point intersecting to southerly line of the U.S,Highway 50/63
Right-of-way as described in paragraph 18 of Report of Commissioners of record in Book 169,Page

N89°077'58"W,along the Section Line, 1390,88 feel to the POINT OF BEGINNING.
Section 22.. The City Council finds and declares that the land described in Section
1 is contiguous to the City boundary; that the annexation is reasonable and necessary to
the proper development of the City, and further, did determine the City has the ability to
furnish normal municipal services to the area.
Section 3, A public hearing was held on May 15, 2006 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section A. The land described in Section 1 shall be zoned C-2 until such time as
the zoning may be changed In the manner provided for by State Statute and City Code.
Section 5 Section 1-17 of the Code of the City of Jefferson, Missouri is hereby
amended by adding one new subsection which shall read as follows:

Section 6. The annexed area shall be in Ward 1 o the City.
Section 7. The effective date of this Ordinance and the annexation of the area described
In Section 1 will be July 1,2006,provided that no written objections to the proposed annexation are
filed with the City Council. If sufficient objections are filed, this ordinance shall not become

effective until such time as the annexation Issue has been resolved pursuant to the provisions of
Chapter 71 RSMo.

COMES NOW,the Petitioners Donald H. Renkemeyer and Velma R.
Renkemeyer, Husband and Wife, and pursuant to the provisions of§ 71.012, RSMo.,
hereby petitions the City of Jefferson City, for voluntary annexation into the City of
Jefferson City, and in support thereof, states the following:
1. That Petitioner is the owner of certain property in Cole County,Missouri,
said property being described in Exhibit A attached hereto as if more fully
and completely set forth herein(hereinafter referred to as"the Property'):
2. This property is not now a part of any incorporated municipality.
3. This Property is contiguous and compact to the existing corporate limits
of the City of Jefferson, Missouri, or is contiguous and compact to other
property petitioned for annexation.
4. That the Petitioner is the owner in fee of all of the Property to be annexed.
• 5. The Petitioner requests that the Property be zoned C-2 and that a Special
Exception Use Permit as proposed on the attached Exhibit B preliminary
site plan be approved. The Petitioner reserves the right to withdraw this
petition if the Jefferson City Planning and Zoning Commission does not
recommend C-2 zoning and approval of the Special Exception Use Permit,
or if the enabling ordinance for the annexation does not reflect the C-2
zoning for the property and the Special Exception Use Permit. The City
agrees that final annexation of the property shall not occur unless the C-2
zoning and Special Exception Use Permit referenced herein is completed
prior to or contemporaneously with the annexation.
WHEREFORE, Petitioner requests that the City of Jefferson City annex the
aforesaid Property subject to the terms and conditions hereof.

COMES NOW, the Petitioners Richard E. Crader and Barbra Ann Crader,
Husband and Wife, and pursuant to the provisions of§ 71.012,RSMo., hereby petitions
the City of Jefferson City, for voluntary annexation into the City of Jefferson City, and in
support thereof, states the following:
1. That Petitioner is the owner of certain property in Cole County, Missouri,
said property being described in Exhibit A attached hereto as if more fully
and completely set forth herein(hereinafter referred to as"the Property"):
2. This property is not now a part of any incorporated municipality.
3. This Property is contiguous and compact to the existing corporate limits
of the City of Jefferson, Missouri, or is contiguous and compact to other
property petitioned for annexation.
4. That the Petitioner is the owner in fee of all of the Property to be annexed.
• 5. The Petitioner requests that the Property be zoned C-2 and that a Special
Exception Use Permit as proposed on the attached Exhibit B preliminary
site plan be approved, The Petitioner reserves the right to withdraw this
petition if the Jefferson City Planning and Zoning Commission does not
recommend C-2 zoning and approval of the Special Exception Use Permit,
or if the enabling ordinance for the annexation does not reflect the C-2
zoning for the property and the Special Exception Use Permit. The City
agrees that final annexation of the property shall not occur unless the C-2
zoning and Special Exception Use Permit referenced herein is completed
prior to or contemporaneously with the annexation.
WHEREFORE,Petitioner requests that the City of Jefferson City annex the
aforesaid Property subject to the terms and conditions hereof.

Part of Section 22, Township 44, Range 11, Cole County, Missouri described as
follows: Beginning at the southwest corner of the Southeast Quarter of the Southeast
Quarter of said Section 22; thence running easterly 220 yards; thence in a northwesterly
direction to a point that is 220 yards north of the point of beginning;thence southerly to
the point of beginning.
Subject to and together with an easement for ingress and egress from U.S.
Highway 50 to the above described property, said easement commencing on the south
side of U.S. Highway 50 at the location in the Southwest Quarter of the Southeast
Quarter of Section 22, Township 44, Range 11, where there is access to U.S. Highway
50; thence over and along a strip of land 120 feet wide, lying on the right or south side of,
parallel to and adjoining the right of way line of U.S. Highway 50, as described in
paragraph 18,40 of Report of Commissioners of record in Book 169,Page 8, Cole County
Recorder's Office, and being across part of LePage's Subdivision, per plat of record in
