RESOLUTION AWARDING CCNTRACT, ,
Be it resolved by the City Council of the City of Lynvaood
as follows:
�"IHEREt1s, this City Council hae heretofore, on nRay 7, 1946,
by�Reeolution No. 1942, ordered the improvement of that property as I
� above described by constructing curbs, gutters and sidewalks e�

'����So notice inviting sealed proposals, or�bids, for
furnishing the materials and supplies described in said Resolution
No. 1942 has been given according to law; and
tiS'HEREAS, the City Clerk has heretofore preaented and filed
his affidavit showing that said notice inviting sealed proposals,
or bids, has been posted conspicuously for more than five days on the
Council Chesnber door of this City Council; and
���5, there has heretofore been filed v�ith this City
Council an affidavit showing that notice inviting said proposals
and referring• to the specifications on file, has been published
twice in the Lynwood Press, a weekly newspaper published and circulated

• in said City-of Lynv�ood which newspaper is the one designated by
this City Council in sa.id Resolution No. 1942 for the said purpose;

tYHEREAS, said posting and publication have been done and
said notice inviting proposals has been given, in the time, form
and manner provided by Streets and Highways Code Division 7, cited as
"Improvement Act of 1911,° as amended; and
� ����5, three proposals, or bids, to furnish said materials .
and supplies, as invited by said notice; were filed with the City
Clerk, c�ho is the clerk of this City CoLmcil within the
time allowed by said:notice; and

by said notice, in open session of this City Council, publicly opened,
exam3ned and declared;-and .

N01", THEREFORE, BE IT RESOLVED by the City Council of
the City. of Lynv�ood as follows:
, Section 1. That the said bid, or proposal of Vido
Kovacevich Co:.zr"�r' is the lowest bid, or proposal for the.furnishing
of the materials and supplies aforesaid,
�• Section 2. That said bid was preserited in the time, form
and manner provided by said notice inviting proposals, or bids, as
provided in the Streets and Hi�hways Code Division 7, clted as

��Improvement Act of 1911,° as amended;
Section 3. That said bid, or proposal, is aceompanied
by a Proposal Bond, payabTe to the City of Lynwood in tzn amouait not
less than the amount specified by said Streets and Ai�hwags Code
Division 7, Chapter 9, cited as �'Improvement Act of 1�91).°.
Section 4, That in the opinion of the Cit,y,Council,
said Vido Kovacevich Cor. �a :;,� is a responsible �bid.der.
Section 5. That Vido Kovacevich Co;s � is hereby a�rdarded
the contract for the furnishing of said materials and supplies in
accorda.nce with their bid, or pr.oposal, aforesaid, sub,ject to the
right of owners of three-fourtha-of the frontage of the..lots and
lands liable to be assessed for said �vork, or improvement, or their
agents, to undertake to perform said work, or improvement, under the
,
provisions•of Streets a.nd Hightvays Code Division 7, Chapter 9, cited
as.°Improvement Act of 1911,��, as amended,
Section 6. That the City Clerk sh�ll cause notice of the
awarding of said contract, as aforesa.id, to"be published twice in
the Lym400d Press, a weekly newspaPer published and circulated in
said City of Lynwood and hereby designated for that purpose.
� Section 7. Should the owners oi three-fourths of the
frontage of said lots and lands, or their fail to elect to
take said.work, and to enter into a written co.ntract to do the same
at the price at whieh the same has been avearded, within ten d.:tys
after the first publication of said notice, or to commence the �vork_
within fifteen days after the date of such written contract, and to
prosecute the same with diligence to completion, under the provisions
of said Streets and Highways Code Division.7, Chapter 9, citecl as
°Improvement Act of 1911,° as amended, then it shalZ be the duty oY
the Superintend.ent of Stireets of;the Gity of Lynwood to enter into a

contract �;�ith sa.id Vido Kovacevich Co7, r:��,z;yr the original bidder to
whom the contract is avaarded by this rescZution, for the furnishing
of said materials and supplies under•the terms and at the price
• specified in their bid.
Section 8. All bids, or proposals, made, except the one
hereinabove accepted, are hereby re,3ected. �
