I/-f©y 0 p AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING FROM RU RURAL USE TO C-2 GENERAL COMMERCIAL, 1.5 ACRES OF LAND TO BE ADDRESSED AS 401 CITY VIEW DRIVE, LOCATED ON THE SOUTH SIDE OF U.S. HIGHWAY 50/63 AT THE TERMINUS OF CITY VIEW DRIVE AND IS PART OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 22, TOWNSHIP 44 NORTH, RANGE 11 WEST, CITY OF JEFFERSON, COLE COUNTY, MISSOURI. WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with. WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the zoning map and the proposed zoning change would not necessitate a change to the Comprehensive Plan Development Plan Map. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The following described real estate is rezoned from RU Rural Use to C-2 General Commercial: Approximately 1.5 acres of land located on the south side of U. S. Highway 50/63 at the • terminus of City View Drive, to be addressed 401 City View Drive from RU Rural to C-2 General Commercial. The property is currently highway right-of-way to be acquired by an adjacent property owner for purposes of development of a superstore/big box retail development, located in part of the Southwest Quarter of the Southeast Quarter of Section 22,Township 44 north, Range 11 West, City of Jefferson, Cole County, Missouri. Section 2. This ordinance shall be in full force and effect on July 1, 2006. Christy Municipal Building, 320 East McCarty Street, to consider rezoning the following property, described below: Section 1. Property Description, Approximately 1.5 acres of land located on the south side of U.S. Highway 50163 at the terminus of City View Drive, to be addressed 401 City View Drive from RU Rural to C-2 General Commercial. The property is currently highway right-of-way, located in part of the Southwest Quarter of the Southeast Quarter of Section 22, Township 44 north, Range 11 West, City of Jefferson, Cole County, Missouri. Section 2. Rezoning application. The property is proposed to be rezoned from RU Rural Use to C-2 General Commercial for Inclusion in a proposed site for a Superstore/Big Box Retail Development consisting of a Wal-Mart Supercenter. The application was filed by the Missouri Department of Transportation, on behalf of the Wal-Mart Corporation, contract purchaser, for the land described In Section 1. The application is on file as Case No. P06017 in the Jefferson City Planning Division. Dear Ms, McMillan: After completion of the City View Drive interchange and the Wal-Mart development an excess parcel of right of way will be incorporated into the Wal-Mart property. This parcel is located in the southeast quadrant of the proposed interchange and measures approximately 1.5 acres, This excess right of way needs to have the same zoning as the remainder of the development when it • is deeded to Wal-Mart. A description of the parcel to be conveyed to Wal-Mart will be prepared by Central Missouri Professional Services and provided to the City of Jefferson.
