Be it resolved by the City Council, of the City of Lynwood
as follovas2 •
WHEREAS, this,C3t,y Counci2 has heretofore, on May 7, 1946,
by Resolution No. 1938, ordered the improvement of that prcperty :
within the abode described.bounda.r3� by constructing curbs, g�utters,
sidewalka and driveway aprons, ar.d
_�w-., _ ''7HEREAS, notice inviting sealed propocals, or bids, for
furnishing the materia_ls and supplies described in aaid Reaolution
� No. 1938 has been given according to law; and
SVH�REAS, the City Clerk has heretofore aresented and filed
' his affidavit ehow.ing that said notiee invitino sealed proposals, or
bida, has been posted conspicuousl3- for more than five days on the
Council Chamber door of this City Council; and - -
4VHEREAS, �rhere has heretofore been filed this City
Gouncil an affidavit sho�ving that notice inviting_saic� proposals and
referririg to the specifica.tions on file, has been published twice in
the Lynwood Preas, a weekly newspaper published and circulated in
said City of Lynivood which newspaper is the one designated by thia
Citg Council in sald Resolution�No. 1938 for the said purpose��'and
YiHEREAB, said poating and publication have been done and
said notice inviting proposAls has been given, 3n the time, form and

s.anner provided by Section 16 of the Streets and Highways Code
Division 7, cited as '�Improvement Act of 1911," as amended; and
W,HERE,A�, tY?ree proposals, or bids, to furnish said mater121e
and supplies, as invited by ea.id notice, were filed with the City Clerk,
, � who is the ex-cfficio clerk of this City Council, within the time
� a1loNed by said notice; and
PlHEREAS, all of said bids were, at the time and pl�ce set
by said notice, in open session of this City Council, publicly opened,
_ examined and declared; and
PIHEREAS, the bid, or proposal, mad2 by Vido Kovacevich Co.
�vas the lowest b3d, or proposal, made for furnishing said. materials
an� suppliea; �:nd

a Proposal Bond in the emount of ° �3,000.00 tuhich is no leas than ten
per cent �f the aggreoate of the said bid, or proposal.

NO�IJ, THEREFORE, BE IT RESOLVED by the City Council of the
City of Lynv�ood as follows:
Section 1. That the said bid, or propoeal, of Vid.o
Kovacevich Co. is the lovoest bid, or proposal for the furnishing of
the mater3als and supplies aforesaid.
� Section 2. That sai& bid was presenteu in the time, Porm
and manner provided by said notice invitin� proposals, or bids, as
provided in the Streets and. Hi�hways Code Division 7, cited aa "Improve-
ment Act.of 1911,�' as amended.
Section 3. That said bid, or proposal, is accompanied by
a Proposal Bond, payable to the City of Lynwood in an amount not less
than the amount specified by said Streets and Highways Code, Division
7, Chapter 9, cited as '�Improvement Act of 1911,°
' Section 4. That in the opinion of the City Council, said

Section 5. That Vido Kovacevich Co. is hereby aw�rded
the contract for the furniahi.ng of said materials and supplies in
accordance with their bid, or proposal, aforesaid:'; sub,�ect te the
right of ovaners of three-£curths of the frontage of the lots and landa
liable to be a�sessed for �aid work, or improvement, or their agents,
to underta.ke to perform said vTOrk, or improvement under the provisiona
of Streets and Highways Code, Division 7, Chapter 9, clted�as "Improve�
ment Act of 1311," ae amended.
Section 6. That the City Clerk shall cause notice cf the
awarding of said coritract, as aforesaid,, to be published twice in the
Lynwood Press, a weekly newspaper published a,nd circulated in said
City of Lyma�ood and hereby,designated Por that purpose.
Section 7. Should the owners of three-fourths of the front-
age of said lots and lands,�or their agents, fail to elect to take
said work, a:nd to enter into a written contract to do Y,he ��me at .
the price at !n�hich the same has been awarded, ta�ithin ten days after
the first publicrztion of s�id notice, or to commence the worli �xrithin
° fifteen days after the date of such written contract, and to prosecute
the same v;ith diligence to completion, under the pro visions of said
Streets and Hi�hvrays Code, Division 7, Chepter 9, cited �,s-"Improvement
Act of 1911," as then it ahall be the duty of the Superintendent
of Streets of the City of Lynv�ooc� to enter into a contract vrith said
Vido Kovacevich Co.,, the original bidder to whom the contract is
awrarde� by this resolution, for the furnishing of s�.id materials and
supplies under the terms an@ at the price sgecified in their bid.
_ Section 8: All bide, or proposals, made, except the one
hereinabove accepted, are hereby re,jected.
