HomeMy Public PortalAbout2011-106 Resolution Granting Private Kennel License to Hanna Buckley 1822 Morgan RdMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2011-106 RESOLUTION GRANTING A PRIVATE KENNEL LICENSE TO HANNA BUCKLEY AT 1822 MORGAN ROAD WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Hanna Buckley (the "Applicant") owns certain property located at 1822 Morgan Road (the "Property") in the City; and WHEREAS, the Property is approximately 9.6 acres in area and City regulations require City Council review in order obtain a private kennel license for keeping more than five dogs on a property eight acres in size or larger; and WHEREAS, the Applicant has requested a private kennel license in order to keep eight dogs on the Property; and WHEREAS, on December 6, 2011, following notice required by City regulations, the City Council reviewed the requested private kennel license and heard from the Applicants and other interested parties; and WHEREAS, the City Council has determined that, provided the Applicant abides by certain terms and conditions, allowing up to six dogs to be kept on the Property will not endanger the health, safety, or welfare of the public or of the animals; nor will it create a public nuisance nor fundamentally alter the residential character of the property. NOW, THEREFORE BE IT RESOLVED, by the city council of the City of Medina, Minnesota that a private kennel license is hereby granted subject to the following terms and conditions: 1) The number of dogs on the property shall not exceed six. 2) The Property shall be kept in a sanitary condition and the Applicant shall pick up all animal waste at least one time per week. 3) No selling of puppies, boarding for fees, or other commercial activities related to the dogs shall occur on the Property. 4) If the City Council determines that it is appropriate upon review of this license as described in condition 11 below, the Applicant shall be required to construct a privacy fence along the north property line. Such fence shall be located in areas where dogs are allowed on the Property adjacent to residential improvements on the neighboring property as shown on a site plan approved by staff. Resolution No. 2011-106 December 20, 2011 5) The Applicant shall ensure that all visitation related to the fostering of dogs takes place off -site. 6) The Applicant shall ensure that sustained barking does not occur which the Police determine may impact neighboring properties. 7) Dogs shall not be allowed outside between the hours of 9 p.m. and 7 a.m. unless accompanied by a person. 8) The Applicant shall ensure that dogs are not allowed to run at -large. The Applicant shall maintain fencing sufficient to ensure the dogs are contained on the Property. 9) The Applicant shall consent to inspection of the Property by the City at any reasonable time in order to review compliance with the terms and conditions contained herein and other relevant regulations related to the keeping of animals. 10) This license shall be valid only for the Applicant named and only on the Property identified. At such time that the Applicant does not reside at the Property, the license shall become null and void. 11) The license shall be reviewed by the City Council in one year, or sooner if additional complaints related to the keeping of dogs on the Property are submitted via the Medina Police Department, at which time the Council may revoke the license or add additional terms and conditions to the license. 12) This license may be revoked if the City Council determines that the Applicant is in violation of the aforementioned conditions or otherwise determines that the operation of the private kennel constitutes a public nuisance.
