COUNCIL MINUTES
SEPTEMBER 12, 2006

The following is a condensation of the proceedings and is not a verbatim transcript. The
meeting is tape-recorded and the tapes are part of the public record_
CALL TO ORDER:
Mayor David Cooper called the meeting to order at 7:00 pm.

APPEARANCES:
Dean Jasper--- Dean Homes Inc.
Mr. Jasper requested zoning and other information regarding a Yarrow Point lot that is for
sale, Parcel Number 1925059157, located at 37XX 941h Ave NE. Mr. Jasper asked if his
request could be included as an agenda item at the next Town Council meeting set for
October 10`h, 2006. Town officials replied that an established process already exists in the
Town for requesting information regarding Town parcels. Mr. Jasper was instructed to make
a formal request for an appointment with Town Planner Mona Green and to include the
parcel number and information being sought as part of the request submitted.
Jean Thompson — Yarrow Point Resident
Mrs. Thompson appeared before the Town Council to appeal a Town Building Official
decision that a fence was required to be erected around a pool being constructed at the
Thompson residence. Town Attorney Wayne Stewart told Mrs. Thompson that there is an
appeal process in place whereby Building Official decisions may be appealed. Attorney
Stewart asked Mrs. Thompson to send a copy of her appeal to Town Clerk Larry Howard and
to make sure that he, Town Attorney Wayne Stewart, received a copy.
MINUTES:
MOTION: Councilmember DesCamp moved to approve the minutes as amended of the
August 8`t' regular meeting. Councilmember Mushei made a second.
Vote: 4 For, 0 Against, 1 Abstain. Motion carried.
CONSENT CALENDAR:
MOTION: Councilmember Rutledge moved to approve the Consent Calendar as presented
including the Wa.rrarit Register dated 09/08/2006 for warrant nos. 15,250 through 15,285
totaling $51,331.00. Councilmember Valaas made a second.

STAFF REPORTS:
Clyde Hill Police Dept:
Lieutenant Kyle Kolling reported that August was a very quiet month in Yarrow Point other
than for criminal traffic, DUI's, one vehicle prowl and one domestic violence incident.
Lieutenant Kolling reported that his department has received reports of an adult male who
has been approaching children in the City of Clyde Hill. Lieutenant Kolling stated that a
good description of this individual has been obtained but that the described individual had
not yet been located.
Lieutenant Kolling in answering a question stated that a seventh officer is going to be added
to the Clyde Hill Police Force and that the Town of Yarrow Point will experience higher law
enforcement costs as a result. Lieutenant Kolling also stated that the Mercer Island Marine
Patrol will be cutting back on their summer patrol of Lake Washington sometime during the
month of October.
0 John Joplin, Fiscal Coordinator:
Mr. Joplin reported that the cost of law enforcement in Yarrow Point in 2007 is scheduled to
increase approximately S22,000 compared to what it was in 2006 and that this increase
primarily represents Yarrow Point's share of the cost of a 7"' officer being added to the
Clyde Hill Police Dept. Fiscal Coordinator Joplin also reported that a Washington State
Auditor's Office bi-annual audit of the Town is scheduled to begin the Monday following
tonight's meeting. Mr. Joplin concluded by reporting that the preliminary 2007 Budget for
the Town will be- on the agenda at the October 10`}', 2006 Town Council meeting.
Vivian Chin, Building Dept. Representative:
Building Dept. Representative Vivian Chin reported that building permit activity increased in
the month of August and that at present there are 94 open permits. Vivian stated that the
Building Department is addressing old outstanding permits. Vivian stated that 30 letters will
be sent out to permit holders requesting the status of old outstanding permits and that 25
additional permits are very close to being finalized.
Clerk Treasurer Larry Howard:
In response to a question from a Council member Town Clerk Larry Howard reported on the
outcome of variance hearing which had been held the week prior to tonight's Town Council

meeting. A request was made that copies of the Town Hearing Examiner's decision be
distributed to all Town Council members.
REGULAR BUSINESS:
AB 05-034 — Citizen Concerns & Solutions — Town Fountain & Road End Beach
Mayor Cooper reported to Council members that a group of Yarrow Point residents had
requested this agenda space to express concerns they have regarding construction of a new
Town Fountain and with problems they have had resulting from their living in proximity to
Road End Beach. Mayor Cooper reported that this same group of residents would also like
to suggest possible solutions to problems and concerns identified.
Eric Lang — Yarrow Point
Mr. Lang reported on a letter sent to the Town and signed by a number of residents who live
in the Town of Yarrow Point. This letter contained concerns that the residents who signed
the letter have regarding the Town's plans to build a new fountain. The letter also contained
proposed solutions to some of the problems and concerns expressed.
John Heller & Terri Olson Miller — Yarrow Point
John Heller & Terri Olson Miller reported on and presented a letter to Council members also
signed by residents of Yarrow Point highlighting problems that they have encountered during
the summer months as a result of living in proximity to Road End Beach. This letter like the
letter presented by Mr. Lang contained suggested solutions to some of the problems
identified.
Joe Robbin — Yarrow Point
Mr. Robbin emphasized that the problems associated with the proposed fountain and the
problems existing at Road End Beach are very closely related. Mr. Robbin suggested that if
the Town made it more difficult for the public to park in the area of the proposed fountain
and in the area around Road End Beach that problems identified to Council members tonight
would be far less significant than they are at present.
Bryan Fleming — Yarrow Point
Mr. Fleming discussed his reasons for signing the letters presented to Council members
tonight and the problems that neighbors in the area of Road End Beach have been
experiencing.
Mayor Cooper recommended that an advisory committee be formed to address the problems
and concerns identified tonight in regards to the proposed fountain. Mayor Cooper and
Council members expressed delight in regards to the number of residents who came and

spoke at tonight's Town Council meeting. Councilmember Mushel and Valaas volunteered
to be on a Town Fountain Advisory Committee and a number of meeting attendees signed up
via a sign up sheet to be on the same committee. Mayor Cooper suggested that staff
members address the problems associated with Road End Beach and come up with proposed
solutions to present to Council members at their next meeting. Neighbors attending tonight's
meeting thanked Council members and Mayor Cooper for providing them the opportunity to
speak regarding their concerns.
AB 06-035 — Washington State Dept. of Transportation SR 520 Project Team
Presentation — SR 520 Preferred Alternative
Team members from the Washington State Department of Transportation Project 520 Team
reported to Council members that recommendations on the Seattle Viaduct and the SR 520
have been made by the State Dept. of Transportation and that those recommendations are
now being presented to affected residents for their review. Team members stated that the
Washington State Department of Transportation is holding open houses in Seattle and
Bellevue in the month of September for citizen input and that in October jurisdictions will be
given the opportunity_ to vote on the preferred alternatives that they like most. Team
members provided a history of the SR 520 and Viaduct projects, proposed schedules for the
projects and described in detail preferred alternative recommendations made by Project
Officials. Team members also addressed questions from Council members.
At the end of the presentation Council members thanked the SR 520 Project Team members
for a very informative presentation.
AB 06-036 — Pathway Landscape Re -Planting Proposal -- Susan Black Landscape
Architects
Mayor Cooper presented a proposal put together by Susan Black Landscape Architects to add
and to replace plants in the landscape area along the 92"d Ave Pathway. Mary Elmore, Town
of Yarrow Point Park Board member, represented the Park Board in the discussion of this
topic.
Mary stated that the Park Board has a number of recommendations as to the re -planting along
the 92nd Ave Pathway. Mary stated that the strawberry plants on the pathway are so low to
the ground that they are barely visible. Mary stated that the Park Board recommends that the
strawberry plants be replaced with plants which grow to a height of at least two to three feet.
In the Susan Black proposal additional strawberry plants are included as part of the
replanting process. Mary .Elmore also reported that Park Board members have suggested
asking Town resident and Landscape Architect Tom Iversen if he would be available to give
advice regarding theTown's landscape projects and landscape needs. Mary also stated that it
was her recommendation that plants used for re -planting around the pathway area be ones
that have aesthetic appeal in winter as well as other seasons.

Council members agreed to make a request to the Park Board to study and make
recommendations as to what type of plants should be used in the re -planting of the 92nd Ave
NE Pathway area. The Town Council also recommended that staff contact Town resident
Tom Iversen to detennine if lie would be available to provide landscaping assistance to the
Town.
AB 06-037 — Proposed Resolution #274 -- Revision of Town Fees & Introduction of a
Pre -Application Conference Requirement for Building Permit Applications
Fiscal Coordinator John Joplin presented an analysis of Town building permit application
revenues versus building permit application costs incurred by the Town for the period from
January 2006 through May 2006. Mr. Joplin stated that his compilation of Building Permit
Application costs included indirect costs of Building Dept, Staff members as well as all
direct building permit application costs. Fiscal Coordinator Joplin stated that his analysis
revealed that building permit application costs in the Town of Yarrow Point clearly exceed
Building Permit revenues realized by the Town. Mr. Joplin indicated that for any
municipality that Building Permit Revenues should always cover permit related costs. Fiscal
Coordinator Joplin stated that Town Clerk Larry Howard had drafted proposed Resolution
#274 and that this resolution was structured to increase fee and deposit amounts for the
various permits issued by the Town.
Councilmember Valaas asked if new funds could be established, one for building permit
revenues and one for building permit costs, so that Council members could better monitor the
balance between- fee revenues and actual costs incurred. Fiscal Coordinator Joplin replied
that he thought this would be possible and that he would review the request with the State
Examiner who will be performing the audit of the Town for the Washington State Auditor's
office.
Mayor Cooper reported that staff is also looking at revising the permitting process so that it
will be more user friendly and a more efficient process. Mayor Cooper stated that a Pre -
Application Review process will be recommended by staff to Council members. Mayor
Cooper stated that the Pre -Application Review process would consist of Town Planner Mona
Green and other staff members sitting down with building permit applicants, examining the
plans and pointing out to applicants any problems found on the plans prior to their going to
the Building Dept. personnel.
Council members reviewed proposed Resolution #275 and made recommendations as to
different terminology and dollar amount changes.

AB 06-038 — Town Fountain Update
Mayor Cooper recommended that since the Town Fountain issue was covered extensively in
AB 06-034 that this agenda item be tabled until a future Town Council meeting.
EXECUTIVE SESSION:
Mayor Cooper announced that the Town Council was going to executive session at 9:50 p.rn.
to discuss personnel issues. Mayor Cooper announced the end of the executive session at
10:39 p.m.
MAYOR AND COUNCIL REPORTS:
None
ADJOURN
MOTION: Councilmember Vasaas moved to adjourn the Council meeting at 10:40 p.m.
Councilmember Rutledge made a second.
Vote: 5 For, 0 Against, 0 Abstain. Motion passed.
