HomeMy Public PortalAbout2012-01 Resolution Reqst MN Dept of Transp in Include Best Mgt PracticesMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2012-01 RESOLUTION REQUESTING THE MINNESOTA DEPARTMENT OF TRANSPORTATION TO INCLUDE BEST MANAGEMENT PRACTICES AS PART OF ITS RESURFACING PROJECT FOR HIGHWAY 55 BETWEEN COUNTY ROAD 116 AND COUNTY ROAD 50 IN THE PIONEER-SARAH CREEK WATERSHED WHEREAS, pursuant to the authority conferred upon them by Minn. Stat §471.59 and §103B.201, et seq., the cities of Greenfield, Independence, Loretto, Maple Plain, Medina and Minnetrista are parties to a Joint Powers Agreement (Agreement) to Protect and Manage the Pioneer -Sarah Creek Watersheds; and WHEREAS, The purpose of this Agreement is to establish the Pioneer -Sarah Creek Watershed Management Commission (Commission) to, in part, protect, preserve, and use natural surface and groundwater storage and retention systems, identify and plan for means to effectively protect and improve surface and groundwater quality, prevent erosion of soil into surface water systems, promote groundwater recharge, and protect and enhance fish and wildlife habitat and water recreational facilities, as identified in Minn. Stat. § 103B,201; and WHEREAS, In 2002, the Minnesota Pollution Control Agency listed Lake Independence as impaired for aquatic recreation under Section 303(d) of the Clean Waters Act. The main cause of the impairment is excessive nutrients in the lake. In response to this listing the Commission was required to develop a Total Maximum Daily Load (TMDL). The Lake Independence Phosphorus TMDL approved by the Environmental Protection Agency (EPA) on February 23, 2007, assessed the nutrient load reductions needed for Lake Independence to comply with Minnesota water quality standards and determined that achieving the desired water quality goal of 36 ug/L requires a phosphorus loading reduction of 1,081 pounds/year, or 45 percent of the current load; and WHEREAS, In 2006, the Minnesota Pollution Control Agency listed Lake Sarah as impaired for aquatic recreation under Section 303(d) of the Clean Waters Act. The main cause of the impairment is excessive nutrients in the lake. In response to this listing the Commission was required to develop a TMDL. The Lake Sarah Nutrient TMDL approved by the EPA on April 25, 2011, assessed the nutrient load reductions needed for Lake Sarah to comply with Minnesota water quality standards and determined that the watershed load must be reduced by 1,108 pounds/year, or 53 percent of the current load to achieve the in -lake water quality goals; and WHEREAS, the Minnesota Department of Transportation (Mn/DOT) is undertaking a resurfacing project on Highway 55 between County Road 116 and County Road 50; and WHEREAS, the Lake Independence watershed has approximately 2.8 miles of Highway 55 right-of-way and the Lake Sarah watershed has approximately 4.2 miles of Highway 55 right- of-way; and Resolution No. 2012-01 January 3, 2012 WHEREAS, the Lake Sarah TMDL determined that Mn/DOT's existing phosphorus load for Lake Sarah is 45.1 pounds/year and its allocation is 17.1 pounds/year, creating a load reduction requirement of 28 pounds/year; NOW, THEREFORE, BE IT RESOLVED that the City of Medina requests the Minnesota Department of Transportation to design the project and implement appropriate best management practices in the Highway 55, County Road 116 to County Road 50, corridor as it undertakes its resurfacing project in order to meet its allocated phosphorus loading limits.
