HomeMy Public PortalAbout2012-07 Resolution Granting Preliminary Plat Approval to JJC Hamel LLC 805 Hamel RdMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2012-07 RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL TO JJC HAMEL, LLC, FOR PROPERTY LOCATED AT 805 HAMEL ROAD WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, JJC Hamel, LLC (the "Owner") is the owner of certain property located at 805 Hamel Road in Hennepin County, Minnesota (the "Property"), which is legally described in Exhibit A, attached hereto; and WHEREAS, the Owner has requested approval from the City of a plat which would subdivide the Property into two lots; and WHEREAS, the Planning Commission held a duly called public hearing on December 13, 2011, where testimony was heard from the Owner, city staff, and other interested parties; and WHEREAS, the Planning Commission recommended preliminary approval of the plat, subject to certain terms and conditions; and WHEREAS, on January 3, 2012, the City Council reviewed the preliminary plat for conformance with City ordinances, considered the recommendations of the Planning Commission and heard comments from interested parties. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that preliminary plat approval be granted to the Owner, subject to the following terms and conditions: 1) Approval is contigent upon Lot 2 being rezoned to R2, Two Family Residential. 2) Right-of-way along Hamel Road and Pinto Drive shall be dedicated as recommended by the City Engineer and shown in the submitted plans. 3) Perimeter drainage and utility easements shall be provided. The City will require 10' front/rear and 5' side yard easements. 4) The Owner shall meet the recommendations of the City Engineers letters dated November 22, December 5 and January 4, 2012. 5) A drainage and utility easement with sufficient access shall be provided encompassing the raingarden. Resolution No. 2012-07 January 17, 2012 6) The Owner shall execute and record an easement satisfactory to the City for the benefit of Lot 2 to maintain existing utility services through Lot 1, until such time that a new principal structure is constructed on Lot 2. Upon construction of a new principal structure on Lot 2, the utility service lines shall no longer be permitted upon Lot 1. 7) In lieu of land dedication, the Owner shall pay a park dedication contribution in the amount of $4,160. 8) Tree replacement shall be required in accordance with Section 828.41 of the Medina City Code. Tree replacement species type, location and size shall be identified on the landscaping plan prior to final plat. Upon review of the final plat, the city council may consider flexibility in the number of trees required to be replaced if the applicant follows Best Management Practices described in Section 828.41 and is able to preserve the large oak tree in the northeast quadrant of Lot 1. A significant number of the required tree plantings shall be placed along the west property line in order to provide screening between the neighboring property. 9) Buffer yards shall be required in accordance with Section 828.31 of the Medina City Code. Buffer yard planting types, location and size shall be identified on the landscaping plan prior to final plat. 10) Access along Hamel Road shall be restricted to one driveway per lot. 11) Upon redevelopment, driveway access for Lot 2 shall be as far away from the intersection of Hamel Road and Pinto Drive as deemed practical or necessary by the City Engineer. 12) All comments from the City Engineer shall be addressed prior to Final Plat. 13) The application for final plat shall be submitted to the City within 360 days of preliminary plat approval or the preliminary plat shall be considered void, unless a written request for time extension is submitted by the Owner and approved by the City Council. 14) The Owner shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat and other relevant documents. Resolution No. 2012-07 January 17, 2012 EXHIBIT A Legal Description of the Property That part of the East 200 feet of the East Half of the Southeast Quarter of Section 11, Township 118, Range 23, lying Southerly of the Rockford Road and Northerly of a line drawn parallel to and distant 183 feet Southerly of and measured at right angles from the center line of the Rockford Road.
