WHEREAS, pursuant to the provisions of Divieion 4 of the Streets and Highways Code, cited as the "Special Assessment Invea- tigation Limitation and Ma,jority Protest Act of 1931", the City Council of the City of Lynvaood has determined that the improvement oP Otis 9treet, et al, is feasible and th�t the public intereat, convenience and neceasity require the improvement substantially as set forth said report, and PIHERF�'+B, said City Council has found that the lands to be assessed will be able to stand the burden of the proposed a�sessment, NO�N, THEREFORE, BE IT RESOLVED by the City Council of the , . Cit,y of 'Lyntivood ae follo�rrs: SECTION 1: That in the opinion of the City Councll of the City of Lynwood the public interest and convenience require and it is the intention of said City Council to order the Pollowing work, "- ' or improvement,,to be done, to-�.vit: � The construction of cement concrete curbs, cement concrete gutters, cement conerete sidewalks and cement concrete drivevray , approaches together with incidental and appurtenant work in certain portions of the folloiving atreets and avenues including portions of intersecting avenues and hiohways: OTIS STREET between the nortnerly line of Imperial Highway and the southerly line of Abbott Road., _ PJIC NERNF.Y AVENUE between the nortnerly line of Imperial Highway and the aout:nerly line of Lot 1 0� Upston Tract as hown on map recorded 3n Book 11, Page 174 of Maps, Records of Los Angeles County, California, and FR.�,CAR AVFI3UE between the northerly line of Imperial Highway and the prolonged -1- 4 ' . , J : - � southerly line of Lot 1 of UostonTract as shown on map recorded in Book 11, Page 174 oP Maps, Recerda of Los Angeles County, California. The construction of cement concrete curba, cement concrete sidewalks, and cement concrete gutters together with incidental and appurtenant work in the following avenues including portions of intersecting avenuea and roada: PINE AVENUE between the northerly line of Pendleton Avenue and the southerly line of Abbott Road, and WASHINGTON AVENUE between the northerly line of Pendleton Avenue and the southerly line of Abbott Road. �All of said work or improvement shall be performed in the public �vays and between the limita hereinbefore deaignated exce.pt where the plans indicate tha.t said work shall be omitted. That all of the work or improvement aforesaid ahall be done and performed in accordance �vith and to the grades shovun on plana, profiles and specifict�tione No. 1947-B on file in the office of the � City Clerk of said city. Said plans are hereby referred to for a I i full and complete deacription of said proposed work and for the grades to which the work is to be done and said plans, profiles and specificatlons are by reference made a part hereof and shall govern for all details of the proposed work. That the estimated coat of said work or improvement is the sum of Eighteen Thousand Four Hundred and Fifty-�ive Dollars (�$18,455.00) SECTION 2: That said contemplated work or improvement, in the opinion of said City Council ie of more than local or ordinary public benefit, and said City Council hereby determines and declared that the district to be benefited by said work, or imnrovement, and to be asseased to pay the costs and expenses of such u�ork or.improve- ment, ls shown on Plan No. 1947-A on file in the ofYice of the City -2- Clerk of said City to which reference is hereby made for a full and complete description of the asaessment district. SECTION 3: The City Council hereby determines and declarea that serial bonds ahall be issued in the manner and form provided in Division 9 of the Streeta and Highways C-ode cited as the "Improvement Ac:t of 1911", as amended, bearing interest at the rate of aix per centum per annum to represent each assessment of twenty-five dollars (�25.00) or over, remaining unnaid for thirty days after the date of the warrant. Said serial bonds ahall extend over a period ending nine years from the second day of January next aucceeding the next . October fifteenth following their date. Sa.id bonda and intereat thereon shall be paid at the office of the City Treasurer and the same shall be disbursed by him, all sa provided in the said'Zmprovement Act of 1911", as amended. SECTION 4� Notice ia hereby given that the provisions of that certain act of the Legislature of the State of California designated as the Streets and Highways Code Division 4, cited as the "Special Aesessment Investigation Limitation and t���ority Proteet Act of 1931", as amended, have heretofore been fully complied with and all the reports required und_er the provisions of said Act are on file in the ofPice of the City Clerk of said City, open to public inspection, and may there be examined by all intereated persona. SECTION 5: The proceedings for the aforesaid work, or improvement, snall be taken under an Act of the Legielature of the State of California designated as the Streets and Hlghways Code Divi- sion 7 cited as the "Improvement Act of 1911", and amendments �hereto. SECTION 6: The City En�ineer is hereby directed to make a diagram of the property affected or benefited by said proposed work ' Y � or improvement as described herein and to be assessed to pay the costs and expenses of said �ork, showing each separate lot, piece or parcel -3- � of land and the dimensions of each such lot, piece or parcel of Zand and the relative location of the same to the work, or improvement proposed to be done, all within the limits of said assessment district. SECTION 7: The City Engineer, who is the Superintendent of Btreets, is hereby directed to poat notices of the passage of this resolution in the time, form and manner required by law, SECTION 8: Notice is hereby given that on Tuesday, the �7th day of October, 1947,� at the hour of.8:00 o�clock P.M., at the � Council Chambers in the City Hall, 11331 Plaza Street, in the City of Lynwood any and ull persona having any ob,ections or proteats to said propoaed work or improvement, or to the extent oP the district to be asaessed or to the grades to which the work is proposed to be done, may appear before said City Council and show cause why said proaosed work, or improvement, ahould not be carried out in accordance vaith this Resolution. - SECTION 9: The City Clerk shall certify to the passage of this Resolution by the City Council of said City of Lynwood and cause the same to be published twice in.the Lyn�•�ood Preas, a weekly news- - , paper publiahed and circulated in said City and hereby desib ated by said City Council for the purpoae aforesaid. Said Clerk is also directed to mail noticea of the adoption of thia Resolution of Intention in the time,form, and manner, and to the persons, all as provided in said "Improvement Act of 1911", as amended.
