HomeMy Public PortalAbout2012-25 Resolution Granting Ext. of Time to File The Fields of Medina PlatMember Siitari introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2012-25 RESOLUTION GRANTING EXTENSION OF TIME TO FILE THE FIELDS OF MEDINA PLAT AMENDING RESOLUTION 2012-05 WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, on January 17, 2012, the City adopted Resolution 2012-05, granting final approval to the Pemtom Land Company (the "Applicant") for a plat called "Fields of Medina," which plats two existing parcels of land which are legally described on Exhibit A, attached hereto the "Property"); and WHEREAS, Mattamy (Minneapolis) Partnership, a Minnesota partnership ("Mattamy"), intends to purchase and develop a portion of the Property with 65 single-family homes; and WHEREAS, the Applicant and Mattamy are individually and collectively referred to herein as "the Developer"; and WHEREAS, under the terms of Resolution 2012-05, approval was valid for a period of 60 days from January 17, 2012, and WHEREAS, the Developer has requested an extension until June 30, 2012 in order to meet the terms and conditions of approval and to file the plat. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, as follows: 1. The "Fields of Medina" plat must be filed with the County Recorder by June 30, 2012 or the final plat shall be considered void, unless a written request for time extension is submitted by the Developer and approved prior to the deadline by the City Council. 2. Except as explicitly stated above, all terms and conditions of Resolution 2012-05 are hereby reaffirmed. Resolution No. 2012-25 April 3, 2012 Dated: April 3, 2012. Ts14- T.M. Marie Railway Company as now located and established; Also The Southwest Quarter (SW'/e) of the Southeast Quarter (SE'/) of Section Two (2), All in Township One Hundred Eighteen (118), Range Twenty Three (23).
