A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE CITY
AND INTEGRITY WASTE ENVIRONMENTAL CONSULTANTS TO CONDUCT AN
AUDIT OF THE CITY'S WASTE AND RECYCLING CONTRACT AND FINDING THAT
ACQUISITION OF SERVICES IS MORE ECONOMICALLY AND EFFICIENTLY
EFFECTED THROUGH THE USE OF AN ALTERNATE PROCEDURE AUTHORIZED
BY THE LYNWOOD MUNICIPAL CODE AND AUTHORIZING THE APPROPRIATION
OF FUNDS TO PAY FOR SAID SERVICES
WHEREAS, the City has entered into a contract with Consolidated Waste
Disposal on September 2, 2003; and
WHEREAS, Consolidated Waste Disposal's contract ends on October 31, 2013
and the contract includes provision for an audit of records by the City or its agents; and
WHEREAS, based on the $4.5 million contract value, the City should exercise
its due diligence by conducting an audit of the contract prior to the contract termination;
and
WHEREAS, Integrity Waste Environmental Services attests that it has the
necessary qualifications to conduct this type of audit based on their November 3, 2010
"Proposal to Perform a Comprehensive PerFormance and Financial Compliance
Evaluation of the City of Lynwood Franchised Refuse and Recycling Hauler".
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD,
CALIFORNIA DOES HEREBY FIND, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. That the City Council authorizes the Mayor to execute an
Agreement between the City and Integrity Waste Environmental Services in a form
approved by the City Attorney in a not to exceed amount of $7,500 for the materials and
cost and 18% of recovery rate as described in the agreement, with a total not to exceed
compensation of $182,000.
Section 2. That the City Council, as evidenced by a 4/5ths vote or better, that
the retention of Integrity Waste Environmental Services may be more economically and
efficiently effected through the use of an alternate procedure, such that the City Council
hereby approves the exercise of the purchasing exemption authorized under Lynwood
Municipal Code Section 6-3.12(a)(3).
Section 3. That the City Council authorizes the appropriation of funds for
payment to Integrity Waste Environmental Services only if the City recovers revenues
pursuant to the terms of the Agreement.
Section 4. This Resolution shall take effect immediately upon its adoption.
