Be it resolved by the City Council of the City of Lynwood as followa: WHEREAS, this City Council has heretoPore, on March 20, 1945, by Resolution No. 1787, ordered the improvement of that property in Tract 11862, Blocks "A" and "B" records of Los Angelea County, particularly bounded on Bullis Road on the 4Yest, Ernestine Avenue on the East, Walnut Avenue on the South, and the property line 149.23 feet North oP Platt Avenue on the North, by constructing curbs, gutters and sidewalks completely around said Block °B" and from the aforesaid North property line around block "A�', along one side of Bullis Road, �lalnut Avenue and Ernestine Avenue and on both sides of Platt Avenue within the above described boundary, by constructing curba, gutters and aidewallss; and FIHEREAS, notice inviting sealed proposals, or bids, for furnishing the materials and supplies described in said Resolution No. 1787 has been given aecording to law; and P7HEREAS, the City Clerk hae heretofore presented and filed his affidavit showing that said notice inviting sealed propasals, or bids,. has been posted conspicuously for more than five days on the Council Chamber door of this City Council; and� ` _1_ ;"hIEREAB� there has heretofore been filed with this City Council an affidavit sho�ing thatnotice inviting said proposals, and referring to the specifications on file, has been puboished twice in the Lynwood Press, a•weekly newspaper published and circulated in said City of Lynwood which newspaper is the one designated by this City Council in said Resolution No. 1787 for the said purpose; and WHEREAS, said poating and publication have been done and said notice inviting proposa.ls has been given, in the time, foMn and manner orovided by Section 16 of the °Improvement Act of 1911," as amended; and - RrHEREAS� three proposals, or �i.de, to furnish said mater- Sals and supplies, as invited by said notice, were filed with the City Clerk, whA is the ex-officio clerk of this City Coun- cil, vrithin the time a11o�Ned by said notice; and WHEREAS, all of said bids were, at the time and place set by said notice, in open sesaion of this City Council, publicly opened, examined and declared; and WHEREAS, the bid, or proposal, made by Vido Kovacevich Co. was the loweet bid, or proposal, made for furniahing said mateaials and supplies; and WHEREAS, last said bid, or proposal, wae accompanied by a Proposal Bond in the amount of �$1,000.00, which is no less than ten per cent of the aggregate of the sa,id bid, or proposal. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynv�ood as follows: Section 1. That the said bid, or proposal, of Vido Kovacevich Co, is the lo�est bid, or proposal for the furnishing of the materials and supplies aforesaid. Section 2. That said bid vras presented in the time, form and manner provided by said notice inviting proposals, or bida� and by Section 10 of the'"Improvement Act of 1911,° a.s amended: -�- Section 3. That said bid, or proposal, is accompanied by a Proposal Bond, payable to the City oP Lynwood in an amount not lesa than ,the amount specified by said Section 10 of said Act. Section 4. That in the opinion of the City Council said Vido Kovacevich Co. is a reaponsible bidder. � Section 5. That Vido Kovacevich Co. is hereby awarded the � contract for the furnishing of said materials and auppliea in accordance �ith their bid, or proposal, aforesaid, sub�ect to the right of owners oP three-fourtha of the frontage of th.e lots and lands liable to be assessed for said work, or improvement, or their agents, to undertake to perform said work, or improvement, under the provisions of Section 12 of the °Improvement Act of 1911,'� a.s amended. ' , Section 6. That the City Clerk shall cauae notice of the awarding of said contract, as aforesaid, to be published t�ice in the Lyn�vood Presa, a weekly newspaper published and circulated in said City oP Lymvood and hereby desi�nated Por that purpose. Section 7. Should the oNnera of three-fourths of the frontage of.said lots and lands, or their agents, fail to elect to take said work, and to enter into a written contract to do the same at the price at which the same has been awarded, within ten days after the first publication of said notice, or to commence the work within fifteen days after the da.te of such written contract, and to proaecute the same with diligence to completion, under the provisions of said Section 12 of the "Improvement Act of 1911,° as amended, then it shall be the duty of the Superintendent of Streeta of the City oP Lynwood to enter into a contra.ct with said Vido Kovacevich Co., the original bidder to whom the contract is awarded by this resolution, for the furnishing oY said materials . a.nd suppliea under the terme and at the price specified in their bid. _3� Section 8.
