HomeMy Public PortalAbout1835 (07-17-45) ' RESOLUTION N0. 1835 A RESOLUTION SETTING FORTH FACTS OF � HEARING AND FINDIiQGS AND CONFIRnnING ASSESSi�1ENT IN AI1D OF THAT IDHPROVEMENT DISTRICT DESCRIBED AS TRAGT 11862, BLOCKS "A° AND "B", RECORDS OF L08 ANGELE5 COUNTY, PARTICULARLY BOUNDED BY BULLIS ROAD ON THE WEST, ERNEST_ INE AVENUE ON THE EAST, WALNUT AVENUE ON THE SOUTH, AND THE PROPERTY LINE 149.23 FEET PdORTH OF PLATT AVENUE ON THE NORTH, IN THE CITY OF LYNPJOOD CALIFORNIA. , THAT THE GITY COUNCIL OF THE CITY OF LYNWOOD� CALIFORI�IA, DOES HEREBY RESOLVE, DETERMINE AND ORDER A8 FOLLOWS: SECTION 1 That the Reaolution of Intention, No. 1770, was duly adogt- ed and contains all the mattera and thinga required by law and is in every reapect legal and avYficient. That said resolution was pasaed at the time and in the form and manner by law required and that no- tices of paseage of said resolution of intention and of the proposed woric, or improvement, therein described were poated at the time and ae by law required; �nd that the notices of adoption of said resol- ution of Intention were mailed postage prepaid at the time and in the manner and to the peraona required by law and affidavita of such pas- sage, posting�and mailing were duly filed as required by lam in the office of the City Clerk of the City of Lyn�vood, California. I That a hearing was held pursuant to said resolution at the time and place stated therein, that there were no protests filed ob- ,�ecting to the proposed work, or improvement; and that Resolution No. 1786 of the City Council was duly passed and a.dopted determining that the City Council had acquired �uriediction to order the proposed work, or improvement, of the aUove deacribed property. That kesolution No. 1787 of this City Council, ordering work, or improvement, of eaid Improvement District, to which resol- ution reference Ss hereby made for further particulara, was on the 20th day of March, 1945, duly adopted. _ _ i ` � _ � .. That notices inviting bide were duly poated and published in accordance with the requirements of law and affidavita of posting and publishing have been duly filed in the office of the C�ty Clerk of said City of Lynwood. _ • That at the time and place provided in sald notice, inviting bids, bids were received and publicly opened, examined and declared, and after an analysis and report by the Superintendent of Streets of said City and the City Engineer of said City of Lynwood, this City Council did award the contract for said work, or improve- ment, to the loweat bidder, to-wit: Vido Kovacevich Company, on the 17th day of April, 1945, re�ecting all other bids. That notice of said contract was duly and properly publieh- ed in accordance wlth law and affidavit of publishing has been duly filed with the City Clerk of sa.id City. --'" That pursuant to the direction of said City Council, the City Engineer prepared a diagram of the property included within the diatrict affected or benefited by the work, or improvement, by the Resolution of Intention No. ���° , and sa13 assessment diagram was duly and regularly approved by this City Council. That on the 19th day of June, 1945, the City Engineer of said City of Lynwood, California, filed with the City Clerk oP f said City of Lynwood the assessment, with attached diagram for the work, or improvement, aforesaid, and the Clty Clerk thereupon fixed . this time and place, to-wit: the City Council Chambere: Cit;� Hall, City of Lynwood, California, a t the hour oP 8 o'clock P. M., July 17th, 1945, for the hearing on said asseasment and published, poated and mailed as by law required the proper noticea of this hearing on said asaessment. ' That a full, fair and impartial hearing was had before thia Council and evidence taken. That this Council finds that the asaess- ment is Just, in accordance with law, and that all of the acts, determinationa, resolutions and ordere, and all of the proceedinga -2- heretofore taken are legal, valid and aufficient, and that the diagram attached to said assessment is legal, valid and suPficient. That no written appeals, proteats or ob�ections were filed prior to the day set for hearing; a.nd that no written appeals, pro- teata or ob�ections were as required by law. SECTION 2 ' That all proteats of every kind and nature are hereby denied and overruled. �ECTION 3 That thia Council ia satisfied with the correctness of the asaessment, and that said proceedinga and said assesament are herebq in ell respects and in all and ever.y particular confirmed, approved and adopted tnis 17th day of July, 1945. .�,,�.:,,. • .
