WHEREAS, Paul and Rayma Chinn, owners of the real estate hereinafter described, having submitted to the City Council a Preliminary and Final PUD Plan of said real estate, being located In Jefferson City, Cole County, Missouri, and more particularly described as follows: Beginning at a point on the north line of Main Street, 518.4 feet east of the west line of said quarter section, said point of beginning also being the southeast corner of a tract of land that John A. WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with, as said property owner submitted to the Planning and Zoning Commission and City Council a Preliminary and Final PUD Plan for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Preliminary and Final PUD Plan prepared by Central Missouri Professional Services, Jefferson City, Missouri, on file as Case No . P05039 in the Office of the City's Planning Division is hereby approved for the property described in Section 1. SECTION 2. The following principal land uses are approved for the site: Multl-family dwellings and otheraccessory uses allowed in the subject PUD,Planned Unit Development district. • i SECTION 3. Approval is made subject to the following conditions: A. The site plan shall be revised as follows:a)label large open areas"Common Area - Open Space"; b) add a note stating "Entrance gales, roadways, sidewalks, and other commonly owned Infrastructure, amenities and open space shall be maintained by the property owners"; and c) add to the sign note "Each entrance sign shall not exceed 24 sq. ft. in area"; B. The Engineering Division and Fire Department shall approve the final design and construction plans for the gated entrance. Prelinlinmy and Final PUD flan.Application filed by Paul and Rnyma Chinn,properiyowners, forapproval ofa Prelfminary:md Final Planned Unit Development(PUD) Plan for the Missouri River Bluffs Condominiums, a 50 unit multi-family residential project on 14.69 acres. Notification By publication in the newspaper, by letter to property owners within 185 feet,and by properly sign posting. Corresnondencc None received as of August 29, 2005, Location and 7omI11g of Subiect Site The subject site was zoned PUD Multi-Family Residential in Junc,2005. It is located 400'west of West Main Strect/West High Street intersection.The site has I I P of frontage on West Main Street which provides the only street frontage to the site.II widens to approximately 590' when it reaches the back ofthe rearyards ofthe homes along West Main Street.The propertyextends 1,500 north to the bluffoverlooking the Missouri River. Surrounding Land Use and Zoning The area cast of the subject site near the river is wooded and zoned RS-3 Single Fmnily Residential.The area to the cast near"lest Main Street is occupied by 5l.Joseph's 1 Ionic and single family dlvelhngs alld is zoned RA-2.The area west of the site contains several single-family residences,which are separn led from the subject site by 250'of forested land owned by the applicant. This area is zoned RS-3 Single Family Residential. Staff Analysis • 1. Zoning Restrictions. The ordinance zoning the property PUD included the following restrictions: 1)that the maximum design density not exceed 3.4 dwelling units per acre fora total of 50 units; and 2)that allowed land uses include multi-family dwellings.'I'he PUD Site Plan complies with these restrictions. 2. Access/1'mffrc Impact. The site has frontage on West Main Street, a two-lane arterial street. Access world be from a private road. In 2002, Average Daily Traffic on West Main cast of hart Street was 3,596. A traffic study determined that the project would generate 7 trips per unit for an Average Daily Traffic of 392 vehicles. Peak hour traffic would be 27 vehicles exiting and 6 entering during the AM peak and 25 vehicles entering and 12 exiting during the I'M peak.The analysis indicated that all movements would operate at Level of Service 13 or better during both the AM and 1'M perk hour. The analysis also showed that there tare more than enough 7.1 second gaps in traffic on West Main Street to satisfy the traffic volume during both the AM and PM peak hour. Sonic on-street parking may need to be removed on Ilia north side of West Main cast of the entrance to provide adequate sight distance. 3. Public Utilities. All public utilities and services can be extended to serve the proposed development. Wa er. Witter service would be from a 6 inch line extended from an existing line on West Main Street. The Fire Department and Water Company will need to deterntine if the dead-end line can provide adequate pressure mid volume to the lire sprinkler system and fire hydrants. Sanitary Sewer. Sewer service would be from it private temporary pump station and a 2 inch I'oree main connected to a City sewer line in West Main Street.The City plans to lay a new gravity sewer line along the creek and build a pump station east of the subject property. A sewer line casement and access drive • from the private road will be required. 'these public sewer facilities could serve the subject property. Other Utilities. PUD Site Plan: The Site Plan proposes 48 dwelling units in llvo, five story buildings with cowered parking and individual garages oil the lower level. Amenities include a club house, swimming pool, patio/gazebo, storage garages(Phase 2), and a gated entrance. The buildings would be clustered oil 2.2 acres near the bluff. The west pill of the building site would be excavated and the cast part would be filled. The remaining 12.5 acres ofthe site would remain as natural open space owned as common area by the owners association. Each dwelling unit would be owned as a condominium with rights In use the commonly owned amenities and open space. 'there is no plan to subdivide the property into lots. Access Road. Access would be from a private road- 24 feel wide with curb and glitter.The road world haven maximum slope of 12%. A small creek crossing will be necessary to reach the building site and a 185' long 12'x G' arch pipe is proposed to provide drainage under the road. Gated Entrance. A divided gated entrance is proposed.The entrance lane is 22' wide with a dual gate that would open in the middle. The exit lane is 16' wide with a single gate. Both gales would swing in the direction of travel. A 15' island would separate the two lades, A turnaround with It 35' radius would be located between West Main Street and the gated entrance to allow vehicles unable to enter the development to make a U turn and exit. The entrance would be landscaped O'ilh Imes and Shrubs. Sidewalk. A 4' sidewalk is proposed along the west side of the access road from West Main Street to the development. Most of the sidewalk would be built as an integral curb and sidewalk. Si art name.Two small block walls are proposed at the entrance. Each wall would have raised metal letters displaying the name of lbe development with ground lights for illumination. No sirs is noted. • Buildings. The proposed buildings would contain 95,750 sq. fl. of Moor space fora PAR ratio of 0.15. Elevation sketches and a description of the buildings have been provided.The exterior fngade will consist of brick masonry and authcatic stucco with ample high-perlbrinanee glazing. Architectural metal will be used to cover the roof deck. Parking. A total of 96 parking spaces are required for the 48 dwelling units, 'There are 113 parking spaces provided—50 in the open garage under the buildings, 20 in individual parking garages, and 43 in the outdoor parking lot. Lielmine. Light poles are shown in the outdoor parking lot and are proposed along the access drive to provide n minimum amount of lighting. Landscaping. Trees will be planted (10 White Ash and 7 Swamp White Oak)around the parking lot. This will provide 15,000 sq. 11. of shading and 13,000 sq. fl, is required. No bulferyarcis arc required. The following comments are regarding this review; Regarding infrastructure; Storm Water- Facilities are proposed to accmmodale runoff from the proposed site. Drainage calculations are needed to verify the design of these facilities. Erosion Control- An existing land disturbance permit has been applied to MDNR for this • site. Erosion control measures need to be incorporated into the site/grading plan. includin!, a temporary granular entrance at West Main Street, silt fence, ditch checks, and inlet protection. A copy of the MDNR Land Disturbance Permit and a copy of the SWPPP will be needed with submittal of a grading permit application for the site. Sidewalk-Private sidewalk is proposed from West Main Street along the entrance drive, to the condominium site to the north to accomodate pedestrian access to the existing sidewalk along West Main Street. Sanitary Sewer- A private sewer lift station is proposed on the site plan. The City of Jefferson is planning to relocate the existing Hayselton Drive Pump Station. (Please see the enclosed memo regarding what items will be needed in conjunction with this future project; regarding an casement for a force main to West Main Street, an casement for an interceptor line across the property, and all ingress/egress casement to a possible future pump station site on the St. Joseph / Heisinger Lutheran Home site immediately adjacent to this site to file cast). Traffic Impact- See general information below, and information in the Planning Division Staff Report. Regarding traffic impact; • The ADT(average daily traffic) for West Main Street east of Boonville Road is 6766 vehicles per day. The ADT for West Main Street cast of Hart Street is 3596 vehicles per day. The ADT for West High Street west of Berry Street is 3159 vehicles per day. • (Source is MoDOT, Jefferson City Traffic Count Summary, August 2002) This development is proposed within an existing residential subdivision. West Main Street is classified as a minor arterial roadway. West High Street is classified as a minor arterial roadway. (Functional classification is from the List of Functional Roadway Classification for Jefferson City, dated April J2, 2000) The speed limit for West Main Street is 30 mpli. West Main Street is a two (2) lane roadway with parking allowed on both sides of the street. Available sight distance for the drive entrance from West Main Street needs to be indicated on the site l2lan both in the westerly and easterly direction: this is needed to verify that distances are consistent with those within the West Main Street corridor. A sanitary sewer is planned along the east-west tributary to the Missouri River. Although the final route of the sanitary sewer Is not known at this time, easements will be required. 2. A sanitary sewer pumping station is planned to the east of the property. An access driveway from the private road will be required. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson desires to annex the unincorporated area of land described in Section 1; and WHEREAS, the owners of the property have submitted a petition to have their property included within the corporate boundaries of the City of Jefferson; and WHEREAS, the property is adjacent to the City and is located near Highway 179, and WHEREAS, a public hearing concerning the annexation was advertised on October 8, 2005 in the Jefferson City Post Tribune; and . NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section L. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has the ability to furnish normal municipal services to the area. Section A. A public hearing was held on October 14,2005 as provided by law,concerning the annexation of the unincorporated area described in Section 1. Section 4. The land described in Section 1 shall be zoned RU until such time as the zoning may be changed In the manner provided for by State Statute and City Code. Section 5.
