Home My Public Portal AboutORD13953 BILL NO. 2005-85 • SPONSORED BY COUNCILMAN FERGUSON ORDINANCE NO. 13°1 5 7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO, AND LYING NORTHWESTERLY OF THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN SECTION 28, IN TOWNSHIP 45 NORTH, RANGE 12 WEST IN THE COUNTY OF COLE, STATE OF MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT. WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson desires to annex the unincorporated area of land described in Section 1; and WHEREAS, the owners of the property have submitted a petition to have their property Included within the corporate boundaries of the City of Jefferson; and WHEREAS, the properly is adjacent to the City and is located near Highway 179, and WHEREAS, a public hearing concerning the annexation was advertised on October 8, 2005 in the Jefferson City Post Tribune; and • NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council Intends to and shall proceed to annex, as provided by law, the unincorporated area of land described as follows, containing approximate 9.3 acres, more or less: Part of the Southeast quarter of the Southeast quarter of Section 28,Township 45, North, Range 12 West,Cole County, Missouri more particularly described as follows: Beginning at the southeast corner of said Section 28; thence North 2 degrees 16 minutes cast along the Section line,961 feet to the center of the Missouri Pacific Railroad tracks;thence along the center of said railroad tracks on the following course and distance; North 69 degrees 45 minutes west,417.38 feet;thence North 71 degrees 40 minutes west, 292.6 feet;thence North 76 degrees 09 minutes west,244.54 feet; thence North 82 degrees 20 minutes west, 76.6 feet; thence leaving the center of said railroad tracks, South 10 degrees 00 minutes cast, 183 feel,more or less,to the center of Gray's Creek;thence along the center ofsaid creek on Clio following courses and distances;North 36 degrees 19 minutes cast, 74.5 feet; thence South 78 degrees 27 minutes east, 242.33 feet; thence South 61 degrees 57 minutes cast, 303.33 feet; thence South 3 degrees 49 minutes west, 610 feet; thence South 28 degrees 12 minutes east, 380.01 feet to the south line of said Section 28; thence leaving the center of Gray's Creek, South 87 degrees 26 minutes cast along the Section line,225 feet to the beginning point of this description, Containing 9.3 acres, more or less. • 30DS OD5,I EXCEPT that part which lies within the Missouri Pacific Railroad right of way. Section 2. The City Council finds and declares that the land described in Section 1 is contiguous to the City boundary; that the annexation is reasonable and necessary to the proper development of the City; and further, did determine the City has the ability to furnish normal municipal services to the area. Section 3. A public hearing was held on October 14,2005 as provided bylaw,concerning the annexation of the unincorporated area described in Section 1. Section 4. The land described in Section 1 shall be zoned RU until such time as the zoning may be changed in the manner provided for by State Statute and City Code. Section 5. Containing 9.3 acres,more or less. EXCEPT that part which Iles within the Missouri Pacific Railroad right of way. The effective date of this Ordinance and the annexation of the area described In Section 1 will be immediate upon passage provided that no written objections to the proposed annexation are filed with the City Council.
