COUNCIL MINUTES
OCTOBER 16, 1990 - SPECIAL MEETING
A Special Meeting of the Bal Harbour Village Council was held
on Tuesday, October 16, 1990 at 5:15 p.m. in the Council Chambers
at Village Hall. The meeting was called to order at 5:15 p.m. by
Mayor Estelle Stern and the roll was called. Those present were:

Village Manager Carole S. Morris
Village Attorney Richard J. Weiss
Administrative Assistant Teresa M. Smith
Absent: Assistant Mayor Matthew B. Blank
As a quorum was found to be present, the meeting commenced.
2. Ordinances - First Reading/Public Hearing:
An Ordinance was read, by title, regulating satellite dish
antennas. Mayor Stern opened a Public Hearing to receive comments.
Mrs. Morris explained the differences between the ordinance
presented and the ordinance previously enacted. The proposed
ordinance provides a definition of satellite dish antenna; provides
a procedure for obtaining a permit for installation of same;
requires additional documents to be submitted and scales therefor;
sets forth locations, sizes, description and provides a grandfather
clause. After discussion, Mayor Stern closed the Public Hearing.
A motion was then offered by Mr. Boggess and seconded by Mr. Taplin
to approve the ordinance entitled
AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA
REGULATING SATELLITE DISH ANTENNAS; REPEALING
ORDINANCE NO. 326; REQUIRING A PERMIT;
REQUIRING COMPLIANCE WITH REGULATIONS;
REQUIRING THAT PLANS AND SPECIFICATIONS BE
SUBMITTED WITH THE APPLICATION FOR THE PERMIT;
PROVIDING REQUIREMENTS FOR THE PLANS AND
SPECIFICATIONS; PROVIDING FOR A SET OF
STANDARDS REGULATING THE LOCATION, HEIGHT,
WIDTH, SETBACK, COLOR, LANDSCAPING, AND GROUND
COVERAGE; PROVIDING FOR INSPECTION; PROVIDING
AN APPLICATION FEE; PROHIBITING SIGNAGE

ATTACHED TO ANTENNAS; PROVIDING FOR A
MECHANISM TO REQUEST VARIANCE FROM THE TERMS
OF THIS ORDINANCE; PROVIDING PENALTIES FOR
VIOLATION; PROVIDING FOR SEVERABILITY;
INCLUSION IN THE CODE; AND AN EFFECTIVE DATE.
as presently submitted with the following amendments to be made
before second reading:
Location of Dishes:
R-1 and R-2 Districts: provide for wall/roof bracket for
stabilization
RM-1, RM-2, RM-3: roof mount/rear of building
RM-4, RM-5 abutting water: roof mount/rear of building
RM-5 not waterfront: roof at rear
PC: ground mount/side yard
Business: roof mount only
O.F.: roof or side
There being no further discussion, the motion carried 3-0.
Dr. Hirschl abstained from voting. (Form 4 Memorandum of Voting
Conflict attached hereto.)
An Ordinance was read by title amending Section 6-9 of the Bal
Harbour Village Code permitting medical and dental offices in the
Ocean Front District. Mayor Stern then opened a Public Hearing.
There being no comments from the public, Mayor Stern closed the
Public Hearing. A motion was offered by Mr. Taplin and seconded by
Mr. Boggess to approve this ordinance on first reading. There
being no further discussion, the motion carried unanimously (4-0)
and this ordinance was approved on first reading as
ORDINANCE OF BAL HARBOUR VILLAGE AMENDING
APPENDIX A, SECTION 6-9 OF THE BAL HARBOUR
VILLAGE CODE; PERMITTING MEDICAL AND DENTAL
OFFICES, INCLUDING SERVICES IN SUCH OFFICES
RELATED TO MEDICAL OR DENTAL CARE PERFORMED
UNDER THE SUPERVISION OF MEDICAL DOCTORS OR
DENTISTS, IN THE OCEAN FRONT DISTRICT;
PROVIDING FOR SEVERABILITY, INCLUSION IN THE
CODE AND AN EFFECTIVE DATE.

Mayor Stern announced that second reading of these ordinances is
scheduled for October 30, 1990 at 5:15 p.m. in Village Hall.
3. Other Business: None
4. Adjourn: There being no further business to come before
Council, a motion was offered by Mr. Boggess and seconded by Mr.
Taplin to adiourn. The motion carried unanimously (4-0) and the
meeting adjourned at 5:35 p.m.
