MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING 0.34 ACRES FROM C-2 GENERAL COMMERCIAL TO PUD PLANNED UNIT
DEVELOPMENT, FOR PROPERTY ADDRESSED AS 215 FLORA DRIVE, LOCATED IN LOT

Approval of Rezoning Application
We recently filed an application with the City to rezone our
new commercial rental property (Lot 9 on Flora Drive) from
the existing C2 to PUD. This was to accommodate one of our
occupants, ValRich Foods L.L.C. that makes LaCasita
Homestyle Salsa. They want to sell and manufacture Salsa
at our rental building.
1) I have talked with all of our neighbors and no one had
• any problems with the Salsa manufacturing.
2) The City staff supports our rezoning to PUD.
3) The Planning and Zoning Commission unanimously
approved the rezoning to PUD with two conditions which
are acceptable to us.
At this time, we are awaiting City Council approval for our
rezoning request that is currently scheduled for
November 21, 2005. We are requesting that Councilman
Kevin Brown accelerate our application for C2 to PUD
rezoning as soon as possible.
Mr. Loaiza, of ValRich Foods, currently rents two locations
and with the rezoning approval, Mr. Loaiza, would
consolidate his operations to one larger location on Flora
Drive. The sooner this consolidation occurs the better it will
serve the operations of ValRich Foods.

Currently, ValRich Foods occupies a much smaller building
and is forced to manufacture their salsa by setting up the
kettles to cook and then dismantling the kettles in order to
make the necessary space to set up the equipment for their
next step in the process of bottling, capping and labeling the
jars of salsa. In the new location on Flora Drive, Mr. Loaiza
will be able to set up his equipment and not require
dismantling of equipment to complete the process of
manufacturing, bottling, capping and labeling the salsa.
ValRich Foods currently offers six flavors of salsa and is
trying to add three additional flavors of salsa and bring
them to market by January, 2006. The salsa is currently
sold through wholesale food distributors located in St. Louis,
Kansas City and Springfield.
• Mr. Loaiza is trying to grow and expand his salsa business
and is in desperate need of a larger manufacturing facility
as soon as possible. Again, we are requesting your
consideration for accelerating the rezoning approval
through the City Council. Thank You.

Re: Rezoning Request From C2 to PUD
The objective of this application is to request a zoning change from
the current C2 zoning to PUD for new business property located at
215 Flora Drive (Lot 9, Spring Valley Subdivision).
The property owners, Phillips 5 Investments, L.L.C., has three rental
units (one building, sub-divided) at 215 Flora Drive. Units' A & B is
leased to ValRich Foods and Unit C is leased to Therapy Support, a
• business that rents hospital style beds and various home health care
products to homebound persons requiring specialty health
equipment. Therapy Support has very low volume as It pertains to
traffic. They have one employee and one delivery van for their
Jefferson City store.
Currently, ValRich Foods, L.L.C., makers of LaCasita liomestyle Salsa,
lease 2 of 3 units (Units A & B) of the building at 215 Flora Drive.
ValRich Foods store and sell the finished Salsa at the Flora location.
The Salsa is produced outside the City in another location.
ValRich Foods would like to combine their two locations and produce,
store and sell Salsa from 215 Flora Drive. This would require the
City of Jefferson to approve a rezoning request from the current C2
to PUD. Therefore, we are requesting approval of all C2 uses plus
Salsa manufacturing.
ValRich Foods vehicular traffic to and from the Flora Drive location
would be very low volume as described in the narrative on Business
Operations (Exhibit B).
The signage for the building occupants Is limited to the 3' glass
entrance door for each unit (location of each door on Exhibit Q.
Preliminary/Final Site Plan is attached as Exhibit C. Please note that
at this time, there are other parcels of property in this area with PUD
zoning: 3 acres at 307 Flora Drive, owned by Gary and M. Janie
Phillips, and approximately 10 acres owned by Corporate Woods
Properties that has several hundred feet of frontage to Flora Drive.
The Corporate Woods Properties Is addressed as Pour Seasons Drive
Lots B, C, D, E, P, G, H and 1716 Pour Seasons Drive.
Additionally, tlhe property owners would like to add a fourth unit
(1350 square foot) that would attach to the east side (Unit C) of the
building and be located on Lot 10 which would remain zoned C2 (see
• Exhibit Q. This unit would be built as a "spec" unit but plans are that
Therapy Support would occupy this additional unit. This is for your
Information only as this would not require a zoning change to
implement and is not included in this application.
Your assistance to secure the rezoning for a PUD at 215 Flora Drive
would be greatly appreciated. The property owners built a quality
building with an all brick and stone frontage that would enhance the
business environment for Flora Drive. It is our belief that ValRich
Foods would be a valuable business asset for both Flora Drive and
Jefferson CIty.
In conclusion, both the property owners and ValRich Foods L.L.C.,
would be agreeable to a "sunset clause" for a three year zoning
change to PUD. At that time, there would be a review by the City
Planning Division and with City approval a renewal could be
Implemented for the PUD zoning.

for commercial as well as for food manufacturing purposes, Approval is also requested for a Preliminary&
Final PUD Plan which reflccls an existing completed development with no additional improvements proposed.

vacant land and the Marvic Skate Center which is also zoned C-2 and owned by the applicant.To file south is

zoned C-2. To the west is another labor building(AFof L)zoned C-2.
Staff Annivsls
A. Rezoning from C-2 to PUD:
• Pernitled Uses. The npplicant is requesting than all C-2 Commercial uses plus salsa nlanuGlcttlring
be allowed on the property. In ml attached letter, the applicant states they would be agreeable to a
three year"sunset clause" for the zoning change. At that tittle, there would be a review and the
City could decide whether to approve a renewal of the PUD zoning.
• Compatibility. A letter front Valltich Foods, makers of IaCasita Iiomestyle Salsa, was submitted
to describe the mature of their business. ValRich currently has four full-time employees and
anticipates adding two more employees in the near future, The letter states that they receive a
tractor trailer sbipmcnt of processed tomatoes and glass jars about once every six weeks and other
minimal spot deliveries. The salsa making process generally occurs as follows: the tomatoes and
other ingredients are cooked in 60-SO gallon electric stainless steel kettles, a commercial dish
washer washes the jars, a piston filler fills thejars with the finished salsa, an automatic capper
places and tightens the lids nn thejars, an automatic labeler places the labels on thejars, and the
jars are then packed in 12 jar boxes and placed on pallets for shipment. The product is distributed
by two delivery vehicles operated by company employees. The leiteralso states that tomato waste
is minimal, the process produces no noticeable offensive odors,and They anticipate no unsightly
accumulation of articles on the property.

• Access(haff is Impact: Access to the property is provided by Flom Drive, an cast-west through
street connecting to Christy Drive and Tanner Bridge Road. The site has 100 feel of frontage on
• Flora Drive swflh Iwo 25' driveways sepaaled by a 10'islancl (sec enclosed site plan). Delivery
trucks would back from the street into the hest driveway. Small trucks would back into the)' wide
loading clock and large trucks would back into ilia 12' wide loading/unloading space in front of the
overhead door between the loading dock and the handicapped parking space. It is approximately
72 feel from Ilse front of the building to the curb line of the street.
13, Preliminaryand Final PUD Ilan:
• Building. The existing 4,050 sq. R. building contacts three suiles. ValRich foods Is leasing suites
A&B and swishes to use ilia 2,700 sq. fl. space to manufacture, store and sell Its salsa. Spite C
contains 1,350 sq. fl. and is leased by Thempy Support, a company which rents hospllal beds and
other home health equipment, The building has a brick veneer aid stone fagacle with three
prefinished overhead doors.The other three sides of the building consist of prefinished metal wall
panels(see enclosed drawing).
• Parking. Parking for the building was planned based on a IOW volatile retail/services use category
which requires I space/400 sq. R. of floor area. As such, 10 parking spaces are required for the
4,050 sq. A. building. The parking lot located fn front of and cast of the building contains 10
designated spaces. Three additional shml-terns parking spaces are also available fn front of the
overhead doors.
• Signage, Signage for business occupants is limited to lettering on the 3' glass entrance door for
each unit.
• • Lighting. Lighting for ilia front entrance and parking lot is provided by two fixtures located on the
front fagacie of Ilse building.
• Landscaping. Four shade trees are provided along the north and cast sides of ilia parking lot
located on Lot 10 cast of the subject property.
Staff Recommendations
A. Staff supports rezoning the site front C-2 le PUD SIIbjCCI to the following conditions:
I. That pcmtitted uses shall lie limited to all C-2 uses plus salsa manufacturing.
2. That three),cars following approval, a review of the use of the property shall he conducted by the
Planning and Zoning Commission which shall forwarded their findings and recommendations to the City
Council.The City Council may approve an extension of the PUD zoning fora specified number ofycars,
approve permanent PUD zoning, or rezone the property to C-2 General Commercial in which case the
property shall cease to be used for salsa manufacturing.
B. Staff supports approval of the Preliminary& Final PUD flan as submitted, subject to ilia issuance of all
necessary electrical, plumbing,and other permits associated with the proposed use,
