CITY COUNCIL
MINUTES
DECEMBER 15, 1987
INITIATION:
1. CALL TO ORDER:
Pursuant to the Agenda posted on December 11, 1987 Mayor
Gillanders called the meeting of the City Council to order
at 7:30 p.m. on Tuesday, December 15, 1987.
2. The invocation was given by Reverend David Brinkley, Church
of Christ, 5272 North Sereno Drive.
3. The Pledge of Allegiance to the Flag was led by Mayor Gil-
landers.

5. CONSENT CALENDAR
Councilman Atkins moved to approve the Consent Calender as
recommended, seconded by Councilman Swain and unanimously
carried.
A. APPROVAL OF MINUTES - Regular meeting of December 1,
1987.
Approved as written.
B. ANIMAL CONTROL JOINT POWERS AUTHORITY APPROVAL OF ANIMAL
SHELTER CONTRACT SERVICES PROPOSED BY THE SAN GABRIEL
VALLEY HUMANE SOCIETY
City Council received and accepted the agreement for
animal control and shelter services per approval by
Animal Control Joint Powers Authority Executive Board.

D. PLANNING COMMISSION ACTION FROM THEIR REGULAR MEETING OF
DECEMBER 8, 1987
City Council received and filed the memo outlining
action taken by the Planning Commission at their regular
December 8 meeting.
E. ACCEPTANCE OF WORK: TEMPLE CITY PARK IMPROVEMENTS -
TERRA CAL CONSTRUCTION, INC.
Council accepted the work of Terra -Cal Construction,
Inc. and authorized the filing of the Notice of Comple-
tion and the release of 10% retention in the amount of
$7,044.27 at the end of the 35 -day lien period.
F. RESOLUTION NO. 87 -2751: APPOINTMENT OF BUDGETED PERSONNEL
City Council adopted Resolution No. 87 -2751 approving
the appointment of budgeted personnel.
G. RESOLUTION NO. 87 -2752: WARRANTS AND DEMANDS
City Council adopted Resolution No. 87 -2752 approving
claims and demands in the amount of $104,822.61.
6. UNFINISHED BUSINESS:
A PROPOSED URGENCY ORDINANCE IMPOSING A MORATORIUM ON
MULTI FAMILY DEVELOPMENT INCLUDING BOTH CONDOMINIUMS AND
APARTMENTS ON R -2 ZONED PROPERTIES ON THE WEST SIDE OF
GOLDEN WEST BETWEEN GARIBALDI AND LONGDEN.
City Manager Koski provided background information
stating that at the City Council regular meeting of
December 1, 1987 Planning Commission was asked for a
recommendation relative to imposing a moratorium on
multiple family residential developments on R -2 zoned
properties on the west side of Golden West between
Garibaldi and Longden. The purpose of the moratorium
was to allow concerned residents in the area an opportu-
nity to gather signatures for a petition to rezone the
area from R -2 to R -1. The Urgency Ordinance would be in
effect for 45 days. The Planning Commission had felt
that a moratorium was inadvisable in view of the fact
the City has recently updated its General Plan and
zoning, and the area has been zoned R -2 for several
years. Additionally, there are no current applications
pending for multiple family developments in this area
and should an application be submitted, the processing
time would normally be 6 to 8 weeks. In a related
action, the Planning Commission agreed to meet in study
session to bring about a consistency in the lot width
requirements for apartments and condominiums in the R -2
and R -3 Zones.
During Council discussion several issues were brought to
point regarding the impact of a possible moratorium or
urgency ordinance. The original intent was to prevent
the building of any apartment buildings until studies
could be completed with reference to the discrepancy of
the present lot width requirement of 80' for condo-
miniums and 50' for apartments. Charles Martin indi-
cated "he is obligated to keep moratoriums to as small
an area as possible and for as short amount of time as
possible ". The question of impact to existing lots was
discussed but due to the lack of enough background
information being available at the time of the discus-
sion, justification could not be found for either the
imposing of a moratorium or urgency ordinance.

Councilman Atkins moved to accept the invitation of the
Planning Commission for a joint study session with place
and time to be coordinated by the City Manager, seconded
by Councilman Froehle and unanimously carried.
7. A. PUBLIC HEARING: APPROVAL OF TENTATIVE TRACT 45892,
CONDITIONAL USE PERMIT 87 -878, VARIANCE (PARKING) 87 -879
AT 10159 LOWER AZUSA ROAD (APPLICANT /OWNER -ROLEX IN-
VESTMENT)
City Manager Koski provided background information
stating that on November 24, 1987 the Planning Commis-
sion approved a Tentative Tract Map and Conditional Use
Permit to allow the development of eight (8) detached
two -story condominiums and a Zone Variance to allow 21
instead of 24 independently accessible off - street park-
ing spaces on the subject site. The site is zoned R -2,
Light Multiple Residential, and contains a total area of
approximately 36,048 square feet or 0.83 acres. Under
the density limitations of the Zoning code and General
Plan, ten (10) units would be permitted. The proposal
involves only eight (8) units and each of these units
would be detached to simulate a single family residen-
tial development. This proposal meets or exceeds all of
the required development standards with the exception of
the required number of off - street parking spaces, spe-
cifically guest parking. The Zoning Code requires three
(3) parking spaces for each condominium unit, two (2) of
which must be in a garage. The subject project is eight
(8) detached units with two -car garages and driveway
aprons which would accommodate parking. If the private
driveways are counted as parking spaces, there is a
total of 37 spaces provided. The Zoning Code, however,
does not provide for tandem parking and, consequently,
the spaces available in the private driveways are not
counted. The City Council is required by the Zoning
Code to act upon all Tentative Tract Map applications.
Mayor Gillanders declared the public hearing open and
invited anyone wishing to address the City Council on
the matter to come forward at this time.
As no one else wished to address the City Council on
this matter, Councilman Atkins moved to close the public
hearing, seconded by Councilman Dennis and unanimously
carried.
Councilman Dennis moved to approve the Negative Declara-
tion,,Conditional Use Permit 87 -878 and Variance 87 -879
at 10159 Lower Azusa Road, seconded by Councilman Swain
and unanimously carried.
8. COMMUNICATIONS:
A. PASADENA JUNIOR PHILHARMONIC COMMITTEE-
Council received a letter from the Pasadena Junior
Philharmonic Committee requesting permission to hang a
banner announcing the 1988 Annual Pasadena Showcase
House of Design.
After discussion, City Council clarified their policy on
the hanging of banners in the City streets which limits
the permits to local organizations and the promotion of
local events. Additionally, they referred the Committee
to the Temple City Chamber of Commerce who could help
this organization publicize in Temple City through other
means.

Councilman Dennis moved to deny the request by the
Pasadena Junior Philharmonic Committee, seconded by
Councilman Froehle and unanimously carried.
B. SAN GABRIEL VALLEY TRANSPORTATION ZONE
City Council received an update from the County Board of
Supervisors regarding the creation of a transportation
zone and the proposed formation of a Joint Powers Au-
thority.
Councilman Dennis moved to receive and file, seconded by
Councilman Atkins and unanimously carried.
C. TRASH DISPOSAL FROM THE CITY OF LOS ANGELES TO THE SAN
GABRIEL VALLEY
Council received a letter from the County Supervisor
Schabarum regarding the disposition of trash from Los
Angeles to the BKK Landfill.
Councilman Swain indicated that she felt it was neces-
sary to make it very clear that the trash currently
being brought into the San Gabriel Valley from Los
Angeles should not be transported, much less any addi-
tional trash and they should be opening up their own
landfills which they had closed. She felt it is a very
important issue now and will continue to be so.
Councilman Swain moved to send a letter of encouragement
and support to Sally Tanner, the Foreman of the Grand
Jury and Pete Schabarum and a letter of displeasure to
the City of Los Angeles, seconded by Councilman Atkins
and unanimously carried.

RECESS TO CRA:
At this time the City Council recessed to meet as the Temple
City Community Redevelopment Agency; approved the Minutes of
the December 1, 1987 meeting, adopted Resolution CRA 318,
Annual Report for July 1, 1986 -June 30, 1987 and adopted
Resolution No. CRA 319, authorizing payment of bills. The
Minutes of the Agency are set forth in full in the Agency's
records.

Councilman Atkins moved to appoint Francine Maldonado as
Deputy City Treasurer, seconded by Councilman Dennis and

12. ADJOURNMENT
On motion by Councilman Swain seconded by Councilman Dennis
the meeting of the City Council adjourned at 8:16 p.m. The
next regular meeting will be held on Tuesday, January 5,
1988, at 7:30 p.m. in the Council Chamber, 5938 North
Kauffman Avenue, Temple City
