Be it resolved by the City Council of the City of Lynwood as folloovs: V�REAS, this_City Council has heretofore, on Januarp 2, 1946, by Resolution No. 1893, ordered the improvement of that pro- perty lying South of Fernwood Avenue and betwreen Bullis Road on the West and Muriel Drive on the East, egcepting Lots 1 and 109 to 116, inclusive, in Tract 10503,.in the City of Lynwood, County of Los Angeles, State of California as described in Map 1945A on file in the office oP the City Clerk of said City within the above described boundary, by constructing curbs, gutters and sidewalks; and, �FTHEREAS, notice inviting sealed proposals, or bids, for furnishing the materials and supplies described in said Resolution No. 1893 has been given according to law; and 1VfiEREAS, the City Clerk has.heretofore presented and filed his affidavit showing that said notice inviting sealed proposals, or bids, has been posted conspicuously for more than five days on the Council Chamber door of this City Council; and I Wf�REAS, there has heretofore been filed with this City i Council an affidavit showing that notice inviting said proposals, and referring to the specifications on file, has been published twice in the Lynwood Press, a weekly newspaper published and circulated in said City of Lynwood which newspaper is the one designated by this City Council in said Resolution No. 1893 for the said purpose; and . _ i . . WHERF�S, said posting and publication have been done and said notice inviting proposals has been given, in the time, form and manner provided by Section 16 of the "Improvement Act of 1911",ae amended; and W::�EREAS, three proposals, or bids, to Purnish said materials and supplies, as invited by said notice, were filed with the City Clerk who is the ex-officio clerk of this City Councim, within the time allowed by said notice; and P7HEREA5, all of said bids were, at the time and place set by said notice, in open session of this City Council, publicly opened, examined and declared; and Th'f�REAS, the,bid, or proposal, made by Nick Perscallo was the lowest bid, or pxvposal, made for Purnishing said materials and supplies; and Wf�REAS, last said bid, or proposal, was accompanied by a Froposal Bond in the amount of �1,900.00, which is no less than ten per cent of the aggregate of the said bid, or proposal. NOVd, TF�REFORE, BE IT kESOLUED by the City Council of the , City of Lynwood as follows: Section l . That the said bid, or proposal, of ATick Perscallo is the low�est bid, or proposal for the f urnishing of the materials , and supplies aforesaid. Section 2 . That said bid was presented in the time, form f and mannar provided by said notice inviting proposals, or bids, and by 5ection TO of the "Improvemer.t Xct of 1911;" as amended. Section 3. That said bid, or proposal, is accompanied by a Proposal Bond, payable to the City of Lynwood in an amount not less than the amount specified by said Section 10 of said Act. Section 4 . That in the opinion of tHe City Council, said Nick Perscallo is a responsible bidder. � Section 5. That Nick 1'erscallo is hereby awarded the contract for the f urnishing of said materials and supplies in accordance with his bid, or proposal, aforesaid, subject to the right of owners of three-fourths of the f rontage af the lots and lands liable to be -., u _ , . ' assessed for said work, or improvement, or their agents, to undertake to perform said work, or improvement, under the provisions of Section 12 of the "Improvement Act of 1911" as amended. Section 6 . That the City Clerk shall cause notice of the awarding of said contraet, as aforesaid, to be published twice in the Lynwood Press, a weekly newspaper published and circulated in said City of Lynwood and hereby designated for that purpose. Section 7 . Should the owners of three-Pourths of the front- age of said lots and lands, or their agents, fail to elect to take said work, and to enter into a written contract to do the same at the price at which the same has been awarded, within ten days after the first publication of said notice, or to commence the work within fifteen days after the date of such written contract, and to prose,cute the same with diligence to completion, under the provisions of said Section 12 of the "Iaprovement Act of 1911," as amended, then it shall be the duty of the Superintendent of Streets of the City of Lynwood to enter into a contract with said Nick Perscallo, the original bidder to whom the contract is awarded by this resolution, for the furnishing of said materials and supplies under the terms and at the price specified in his bid.
