AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING THE ALLEY RIGHT-OF-WAY FOR A PORTION OF EAST MCCARTY
STREET, AND RELINQUISHING ALL EASEMENT RIGHTS.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri,that
the owners of land adjacent to and abutting upon 1213 East McCarty Street in the City,
have petitioned the City Council to vacate a right-of-way; and
WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue a portion of the right-of-way abutting upon 1213
East McCarty Street for public use as described in Section 1 of this Ordinance; and
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:

Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as a right-of-way a portion of property
abutting property located at 1213 East McCarty Street and forever vacate the following
described right-of-way In said City:
Part of Outlot No. 61 in the City of Jefferson, Missouri described as follows:
Starting at a point on the easterly line of Benton Street,which is 5.0 feet easterly
from the westerly line of Outlot No. 61 and 418.0 feet southerly from the
northerly line of said Outlot No. 61 and also at the intersection of the east line of
Benton Street and the north line of East McCarty Street, thence S49 034'33"E
23.0 feet along the north line of said East McCarty Street to the POINT OF
BEGINNING.
Thence along said north line of said East McCarty Street S49 034'33"E 62.0 feet,
thence leaving said north line S42021'W8.5 feet,thence N4801 1'23"W 61.97 feet,
thence N42021'E 7.0 feet to the POINT OF BEGINNING.
The above described property is part of the Southwest Quarter of the Northeast
Quarter of S17-T44N-R11W-5PM and is part of Outlot No. 61 in the City of
Jefferson, Missouri and is part of East McCarty Street.
Property contains that part of East McCarty Street vacated by the City of
• Jefferson, Missouri as described in a Quit-Claim deed as recorded in Book 253
at Page 616.
• Section 2. The statutory right of reversion in the owners of the abutting property Is
hereby confirmed, as Is provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area vacated,
as described In Section 1 of this ordinance, In the alley right-of-way vacated.
Section 3. This Ordinance shall take effect and be In full force from and after Its
passage.
