RESOLUTION OF INTENTION. , �,�IHEI3EAS, the City Council of the City of Lynwood, County of L os Angeles, State of California, pursuant to the `Streets -, Highways Code Division 4 cited as "Special Assessment Investigation, '� Limitation and Majority Protest Act of 1931," and after hearing � � thereon has made its findings and determination, covering the pro- � posed construction of sidewalks,.. curbs;. and guttera, and�^.all appurtenant work in the streets and alleys included in the district hereinafter described, and said City Council has determined that;the pro�ect is feasible and the public interest, convenience and necessity req_uis�e the improvement substantially as set forth in said report, and WHEREAS, the City Council has found that the lands to be assessed w'ill be able to.stand the burden of the proposed assessment, NOW, THEREFORE, BE IT RESOLVED by the City Council oP the City of Lynwood, California, as follows: Section 7L : '�hat in the opinion of the City Council of the City of Lynwood the public interest and convenience require and it is the intention oP said City Council to order the following work, or improvement, to be done, to-wit: � The construction of sidewalks, curbs, and gutters and all appurtenant work in thestreess and alleys in the City of Lynwood, �ounty of Los Angeles, State of California, described as follows: Beginning at the intersection of the Center Lines of Bullis Road and Morton Road, thence southerly along the ' center lihe of Bullis Road to a point of intersection with the•northerly boundary of the Pacific Electric right-of- w.ay, thence southeasterly along the north boundary of the aPorementioned right-of-way to a point of intersection of the center line of Ernestine Avenue, thence northerly along the center line of Ernestine Avenue to a point of inter- section with the.center line of an alley lying between morton Road on the north and Fernwood Avenue on the south, thence southeasterly along the center line of Gertrude Drive, thence northerly along the said center line to a� point of intersection with the center line of Morton Road, , thence westerly to the point oS beginning That the cost oP such work, or improvement, it is estimated will not exceed the sum of Five-thousand Six Hundred Twenty-seven and-99/100 Dollars (�5,627.99). That all the work and improvment aforesaid shall be done and performed as shown,on and in accordance with and to the grades shown ' on the plans, profiles`and specifications tharefor Piled in the -office o£ the City Clerk in the City Hall oP said City of Lynwood. Said plans are hereby referred to for a£ull and detailed description of said proposed work and for the grade to which the work is to be done and are made a part hereof. Sedtion 2: That, pursuant to the provisions of the Streets and Highways Code Division No. 7 cited as "Improvement Act of 1911," as amended, the City Council of the City of Lynwood proposes to do the ,` above work, or improvement, by contract; no contribution oP either • labor or materisl will be made by the City of Lynwood, and the entire cost oP said improvement is to be paid by special assessments upon benefited property. Section 3: All of the work, or aforesaid, described in Section 1 hereof shall be done in accordance with and to the grade shown on Plans and Specifications No. 1946-A for the -2- improvement of the aPoresaid streets, avenues, alleys and intersections by the construction of sidewalks, curbs and gutters and all appurtenant work, which is on file in the ofYice of the City Clerk of the City of � Lynwood, California. Said plans and epecifications are hereby referred to for a full detailed description of said proposed work, or improvement, and for the�description of the grade to which the work is to be done and are made a part hereof. Section 4: .The work, or improvement, for the furnishing and delivery by the Contractor oP all labor, materials and supplies, shall be furnished and delivered in accordance with Plans and Spec- ifications No. 1946-A for furnishing and delivering materials in connection with the construction of said sidewalks, curbs and gutters and all appurtenant work on file in the office of the City �lerk of the City of Lynwood, California. Said Plans and Specifications are hereby referred to for further particulars and are made a part ; _ hereof.. ... , •' Section 5 : Said contemplated work, or improvement, in the �, opinion of the City Council, is of more than local or ordinary public , benePit, and the Ctty Council hereby determines and declares that ' the district to be benefited by said work, or improvement, and to be` . assessed to pay the costs and expenses oP furnishing all the materials amd supplies necessary to do the abo8e work, or improvement,'is the district described in Section 1 of this Resolution, and as outlined in Plan �No. 1946-A on file in the OfPice of the City GTer, reference to which is hereby made for more particulars. Section 6 : That it is determined that no part of the cost of said improvement is to be paid by the �'ity of Lynwood. The entire cost of labor, materials and supplies is to be paid by special assess- ments upon benefit:�d property, and all the labor, materials and supplies, the cost of which is to be paid by said special assessments upon bene- fited property, and which will be,furnished and delivered by the -3- . � Contractor in accordance with said Plans and Specifications No. 1946-A . on file in the office of the City Clerk oP the City of Lynvrood. � Reference is hereby made to said Specifications for a fullland com- plete description and said Specifications shall govern for all �etails. Seetion 7: The City Council hereby determines and declares ' that serial bonds shall be in the manner and form provided in the Streets and Highway*s Code Division 7 cited as "Improvement Act of 1911," as amended, bearing interest at the rate of six per centum per annum to represent each assessment of-twentp-five Dollars (�25.00)', or over, remainin� unpaid for thirty days after the date , of the warrant. Said serial bonds shall extend over a period ending nine years from the second day'.of January next succeeding the Next October fifteenth following their date. Said bonds and interest there- on shall be paid at the office of the C3ty Treasurer and the same shall _ be disbursed by him, all as provided in the,Streets and Highways Code Division 7 cited as " improvement Act oP.1911," as amended. Section 8: Notice is kiereby given that the provisions of that certain act of the Legisl.ature o£ the State of California de- signated as the Streets and Highways Code Division 4 cited as " "Special l�ssessment Investigation Limitation and Majority Protest Act of 1931,TM as amended, have heretofore been fully complies with and all the reports required,under. the provisions of said Act are on _ 'file in the office of the City Clerk of the said City of Lynwood, open to publie inspection, and may there be examined by all interested , persons. , � Section 9: The proceedin�s for the aforesaid proposed work, or improvement, shall be taken under an Act of Legislature of the State of California designated as the Streets and Highvrays Code Division 7 cited as "Ir.iprovement Act of 1911," and amendments thereto. � Section 10: Trie City �ngineer is hereby directed to make , s diagram of the propertp affected or benefited by said proposed work, or improvement, as described in this Resolution oP Intention and to be assessed to pay the e�enses oP said work, or improvement, . s -4- showing each sepaTate lot, piece or parcel of land and the dimensions of each such lot, piece or parcel of land and the relative location of the same to the work, or improvement, proposed to be done, all within the limits of said assessmant district. Section 11: The City Engineer, who is the Superintendent of Streets, is hereby directed to post notices of the passage of this resolution and of said improvement in the manner provided by said Streats and Highways Gode Division 7 cited as TMImprovement Act oP 1911," as amended. Section 12: Notice is hereby given that on Tues�ay, the �7th of May, 1946, at the hour of 8;00 o'clock P.M. at the Council Chamber in the City Ha11,.11831 Plaza Street, in the City of Lynwood, 6alifornia, any and all persons having any ob�ections or protests to said proposed work, or improvement, or to the extent of the district to_be assessed, or to the grades to which the work is proposed to be . done� may appear before said City Council and show cause why said proposed work, or improvement should not be @arried out in accordance with this Resolution. � Section 13 : The Gity Clerk shall certify to the passage . of this.Resolution by the City CounciT of the City oP Lynwood and cause;�the same to'be.published twic.e in the Lynwood Press, a weekly newspaper published and circulated in s�id City and hereby designated by,said City Couneil for the purpose aforesaid. Said Clerk is also directed to mail notices of the adoption of this Resolutiori of inten- tion in the time, form and manner, and to the persons, all as pro- vided by said Streets and Highways Code Division 7 cited as "Improne- w , ment Act of 1911," as amended. • APPROVED and ADOPTED this 2nd day of April, 1946. ` .
