ORDINANCE NO. 13-q -7
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL PLAT OF EAST HAVEN WOOD ESTATES,SECTION FIVE,A SUBDIVISION OF THE
CITY OF JEFFERSON, MISSOURt.
WHEREAS, John and Linda Kleffner, owners of the real estate hereinafter described,
having submitted to the City Council a plat of said real estate, being located In Jefferson City, Cole
County, Missouri, and more particularly described as follows:
A Replat of Lot 8 & Part of Lot 7 of Capitol View Heights as per plat of record in
Plat Book 4, page 86 and Reserved Tract "A" of East Havenwood Estates
Section One as per plat of record in Plat Book 11, page 378, Cole County
Recorder's Office, being a part of the Southeast Quarter of the Northeast
Quarter,Section 21,Township 44 North,Range 11 West,Cole County,Jefferson
City, Missouri, more particularly described as follows: BEGINNING at the
southeast corner of said Reserved Tract"A'of East Havenwood Estates Section
One, as per plat of record in Plat Book 11, page 378, also being the northerly
right-of-way line of Jennifer Drive;thence S86'28'23"W, along the southerly line
of said Reserved Tract"A", also being the northerly right-of-way line of Jennifer
Drive, 315.50 feet to the southwesterly corner of said Reserved Tract A, also
• being a point on the easterly right-of-way line of Capitol View Drive; thence
northwesterly, along the easterly right-of-way line of Capitol View Drive, on a
curve to the left having a radius of 455.39 feet, an arc distance of 139.33, (the
chord being N16'44'42"W, 138.78 feet) to the northwesterly corner of Lot 8 of
Capitol View Heights as plat of record in per Plat Book 4, page 86, Cole County
Recorder's Office; thence N86'28'23"E, along the northerly line of said Lot 8 of
Capitol View Heights, 349.08 feet to the northeasterly corner thereof,also being
a point on the westerly line of Lot 1 of said East Havenwood Estates Section
One;thence S02'44'39"E,along the easterly lines of said Lots 7 and 8 of Capitol
View Heights, and along the easterly line of the aforesaid Reserved Tract"A"of
East Havenwood Estates Section One, 135.12 feet to the point of beginning.
Containing 1.02 acres.
WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Plat of East Havenwood Estates,
Section Five, that all taxes have been paid, and that in all respects the requirements of Chapter
445,RSMo,entitled"Plats"have been fully complied with by the owner of said subdivision,and that
In all respects the requirements of the Planning and Zoning Commission of the City of Jefferson,
Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the plat of East Havenwood Estates, Section Five, lying, being and
situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat

• attached hereto and made a part of this ordinance, is hereby approved and accepted by the City
Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

This property consists of a 1.02 acre parcel which contains a single-family dwelling oil the west portion of
the site facing Capitol View Drive. The owner wishes to divide file parcel north-souill and use the large
rear yard to create a second building lot facing Jennifer Drive.The 2-lot repinl consists of Lot 8 and purl of
Lot 7, Capitol View, heights plus Reserved 'i-ract A of Last I lavenwood I-states, Section One. 7Tnc site and
arca is zoned RS-2 Single-family Residential.
Description of Proposal
• Lot Sizc: The proposed 2 lots each contain over 22,000 sq. R. of land area. The RS-2 zoning
district requires 12,000 sq. ft. for a corner lot and 10,000 sq. A. for an interior lot so the proposed
lots exceed minimum area requirements.
• Lot Width: The proposed lots arc 135 and 165 feet wide, RS-2 requires n lot width of 80 feet so
the proposed lots exceed minimum width requirements.
• Streets: The lols have frontage on Capitol View Drive and Jennifer Drive, each of which haven
right-of-way width of 50 feet.Jennifer Drive is a concrete street with integral curb.
• • Sidewalks: No sidewalk is proposed across the front of either of the proposed lots.Thcrc are no
existing sidewalks on tither side of Capitol View Drive or Jennifer Drive in this area,
• Drainage: Lot and street drainage is provided by curb and gutter. Street inlets and underground
slonn sewers exist along both Capitol View Drive and Jennifer Drive.
• Ulililies: A 10'sanitary sewer easement is located cast of and abulling the new lot and an 8"
sonila y sewer line is proposed to be extended in this casement to serve the new dwelling. Water
and gas service lines will be extended to tine dwelling from existing lines localed in Jennifer Drive.
Electric and telephone service lines will be extended to the new dwelling from underground lines
located in the vicinity.
• Other: A fire hydrant is located on Jennifer Drive 150 feel cast of the new lot. A street light exists
at the intersection of Capitol View Drive and Jennifer Drive,
Staff Recommendation
Approve the plat, subject to compliance with any recommendations and technical corrections of the
Engineering Division.

Case No. P05053 - Final Plot of East Havenwood Subdivision, Section Five (5), 363 Capitol
View Drive(RS-2)
COMMENTS:
The Engineering Division has done a technical review of the latest submittal of the final plat as
submitted by Central Missouri Professional Services, inc. items concerning Engineering
Division review in Section 33-8. of the Subdivision Code pertaining to final plat contents have
been addressed on the latest copy of the final plat. The following comments arc regarding this
review;
Regarding infrastructure;
Infrastructure is existing in (fie vicinity to serve the subdivision. New infrastructure is
proposed includes a sanitary sewer main extension for the subdivision to serve the new
• proposed lot.
Sidewalk is not shown as an improvement on this plat. No sidewalk exists in the vicinity.
According to requirements of the Subdivision Code, sidewalk is required. Prom a
constructability standpoint, it appears that it is feasible to construct along Jennifer Drive.
Along Capitol View Drive, grades behind the existing curb line of the yard may require a
reduction or elimination of the green space between a proposed sidewalk and the existing
curb line. New sidewalk has been placed from the existing home out to the street. In
order to construct sidewalk along the street, part of this sidewalk would need to be
replaced, and significant grading would need to occur in the existing front yard.
Regarding traffic impact;
The proposed subdivision is an in-611 development within an existing residential area,
impact upon traffic will be minimal.
ENCINF.FRING STAFF POSITION:
Support. Unless consideration of a variance be presented, and considered by ilia Planning and
Zoning Commission, appropriate sidewalk should be shown on the final plat.
