AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A
PRELIMINARYAND FINAL PUD PLAN FOR FRIENDSHIP TOWNHOUSE SUBDIVISION,
LOCATED ON A 0.86 ACRE TRACT ADDRESSED AS 2423 AND 2427 BEASLEY
COURT, JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, Friendship Leasing, LLC, owners of the real estate hereinafter described,
having submitted to the City Council a preliminary and Final PUD Plan of said real estate,
being located in Jefferson City, Cole County, Missouri, and more particularly described as
follows:
Part of Lot 2 and all of Lot 3, Beasley Subdivision, Jefferson City, Cole
County, Missouri. Containing approximately 0.86 acres.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning
have in all matters been complied with, as said property owner submitted to the Planning
and Zoning Commission and City Council a Preliminary and Final PUD Plan for the above
referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
• SECTION 1. The Preliminary and Final PUD Plan submitted by Central Missouri
Professional Services, Jefferson City, Missouri, on file as Case No. P05047 in the
Jefferson City Planning Division is hereby approved for the above land referenced herein.
SECTION 2. The following principal land uses are approved for the site: Multi-
family dwellings and other accessory uses allowed in the subject PUD, Planned Unit
Development district.
SECTION 3. Approval Is made subject to the following conditions:
A. Approval of the Final Subdivision Plat of Friendship Townhouses so that the
existing buildings and tracts may be replatted Into 10 individual lots;
B. Recommendations and technical corrections of the Engineering Division.
SECTION 4. Common Areas and Public Land. No common areas are proposed
and no lands are dedicated to public use with this PUD Plan,
SECTION 5. Access: Vehicular access is through a separate entrance driveway
to the parking area in front of each building.
SECTION 6. Subject to private restrictions and covenants of record as maybe filed
with Friendship Townhouses Subdivision.
SECTION 7. This ordinance shall be in full force and effect from and after the
date of its passage and approval.

a. The project is designed to allow the individual sale and ownership of two 5-unit
apartment buildings that were built in the late 1980s. The present structures are
two story units with a walkout basement. Access and parking will be provided
for through declaration and restrictions. All public facilities and infrastructure is
in place.
b. The preliminary and final as built site plan is attached as a part of the submittal.
C. The replat of part of Lot 2 and all of Lot 3, Beasley Subdivision, is attached.
• d. Appropriate bylaws, restrictions and covenants are being drafted for submittal.
e. A formal Traffic Impact Analysis is not required.

The subject property is located on the south side of Beasley Corot,a cul-de-sac off Tanner Bridge Road. The
site and surrounding property is zoned PUD and the property served by Beasley Court is developed with nmllk
familydwellings,whilcnll ofthe nearby residential units are individually owned as condominiums,the subject
property is currently in single ownership and the individual units are rented.

The applicant is requesting approval ofa preliminary mid Final PUD Site Plan and Replat in orderto allow the
sale and ownership of individual dwelling units within thetwo apartment buildings. Each buildingconlnins 5
two-story mots with a walk-out basement.Rather than creating a condominium,the applicant wishes to create
a single-family atlached lownhome ownership arrangement whereby title would be conveyed to each dwelling

service employees over tiny lot owner's driveway, access road and parking area that provides access from
Beasley Court to the lot. Two variances to the subdivision regulations are needed for the two parcels to be
replatted into 10 individual lots, First, Lot 3A does not have frontage on a public street.Second,all lots except
Lot 21- have less than the required 35 feel of frontage on a cul-de-sac. These requirements arc intended to
ensure that emergency vehicles have adequate access to individual building lots and to prevent driveways from
consuming the entire street frontage. In this ease, adequate access exists to the buildings and no additional
driveways tire proposed. 'Thus existing access will not be diminished by the lownhome plan and replat.
Setbacks, The proposed buildings set back from all exterior lot lines in excess of file 10 foot minimum
requirement.Attached townhomes arc allowed to have a zero setback at the conuion wall or interior lot line.
Parking, Two parking spaces are located in front of each residential unit. A I lomcowners Association will
maintain the driveways and parking areas and other improvements which benefit all lot owners.
Stormwtaer. A 12"pipe in a 10'drainage casement located on the adjacent lot to the cast conveys r noff from
the street inlet at the end of the cul-de-sac to the rear of the adjacent lot.
Utilities. All publicutilitiesandcascmentsarcinpluccandnochangesareptoposcd.'I'hcDcclarniongrmisa
pennanent casement over every lot to all lot owners for the purpose of installing and repairing utility lines.
Sidewalks. No sidewalks exist along Beasley Corot and none arc proposed.
Staff Recommendation
• Staff recommends approval of the Preliminary and Final PUD Plan and Replat, including the two variances,
subject to compliance with the recommncndations and technical corrections of the Engineering Division.

COMMENTS:
The Engineering Division has done a technical review of the site plan/subdivision replat as
submitted by Central Missouri Professional Services. The following comments are regarding this
review;
Regarding infrastructure;
Infrastructure is existing, including street, storm sewer, and sanitary sewer.
Sidewalk does not currently exist upon the property, nor in the vicinity along any City
streets. However, the cul-de-sac of Beasley Court is less than 400 feet in length, so the
Subdivision Code does not require sidewalk to be constructed for a cul-de-sac less than
400 feet.
Regarding traffic impact;
Traffic impact does not change, since no improvements are being made to the property.
