HomeMy Public PortalAbout1990-11-13 Special Meeting54 COUNCIL MINUTES SPECIAL MEETING - NOVEMBER 13, 1990 A Special Meeting of the Bal Harbour Village Council was held on Tuesday, November 13, 1990 in the Bal Harbour Village Hall Council Chambers. The meeting was called to order at 5:20 p.m. by Mayor Estelle Stern and the roll was called. Those present were: Mayor Estelle Stern Asst. Mayor Matthew B. Blank Councilman James E. Boggess Councilman Andrew R. Hirschl Absent: Councilman Sol M. Taplin Also present: Richard J. Weiss, Village Attorney Carole S. Morris, Village Manager As a quorum was determined to be present the meeting commenced. 2. Ordinances - Second Reading/Public Hearing: Mrs. Morris read the proposed ordinance by title. Mayor Stern then opened a public hearing and, as no one desired to speak, closed a public hearing on this ordinance. Mr. Weiss recapped the problem encountered by the Village due to enactment of this ordinance, namely that we would be unable to issue building permits for new construction on vacant lots in the residential district. Mr. Weiss outlined three alternatives for the Council. First, to amend the ordinance presented to exempt the R-1 and R-2 districts. Second, to enact the ordinance as written and to , upon application for a permit, require each property retain its own stormwater. Or third, to defer second reading of this ordinance in order to obtain estimated costs for stormwater retention (i.e. construction of french drains, etc.). Dr. Tom Kelsey, Craig A. Smith and Associates, explained the review process completed by the Department of Community Affairs (hereafter "D.C.A.") in evaluation. It is required that we submit work products as we have completed this project utilizing grant funding obtained through D.C.A. After some further discussion, a motion was offered by Mr. Boggess to amend the ordinance to exempt lots vacant as of this date in the R- 1 and R-2 zoning districts. The motion was seconded by Dr. Hirschl and carried unopposed (4-0). A motion to enact the ordinance, as amended, was offered by Dr. Hirschl and seconded by Mr. Boggess. This motion carried unanimously (4-0) with the following ordinance enacted. ORDINANCE NO. 356 ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING THE VILLAGE CODE BY ADDING APPENDIX D, ADDITIONAL LAND DEVELOPMENT REGULATIONS; ADOPTING BY REFERENCE CHAPTER 28, SUBDIVISIONS OF THE CODE OF METROPOLITAN DADE COUNTY, 55 FLORIDA TO PROVIDE FOR SUBDIVISION AND PLATTING REGULATIONS; ADOPTING BY REFERENCE SECTION 24-12.1, PROTECTION OF PUBLIC POTABLE WATER SUPPLY WELLS, OF CHAPTER 24, ENVIRONMENTAL PROTECTION, OF THE CODE OF METROPOLITAN DADE COUNTY, FLORIDA TO PROVIDE FOR PROTECTION OF POTABLE WATER WELLFIELDS; ADOPTING BY REFERENCE CHAPTER 11C, DEVELOPMENT WITHIN FLOODPLAIN HAZARD DISTRICTS, OF THE CODE OF METROPOLITAN DADE COUNTY, FLORIDA TO PROVIDE FOR REGULATION OF FLOODPLAIN AREAS; ADOPTING BY REFERENCE SECTION D4, WATER CONTROL, OF PART 2 - PUBLIC WORKS MANUAL OF METROPOLITAN DADE COUNTY TO PROVIDE FOR DRAINAGE AND STORMWATER MANAGEMENT; ADOPTING BY REFERENCE CHAPTER 33D, BISCAYNE BAY MANAGEMENT, OF THE CODE OF METROPOLITAN DADE COUNTY, FLORIDA TO PROVIDE FOR PROTECTION OF ENVIRONMENTALLY SENSITIVE LANDS; PROVIDING FOR A SYSTEM FOR THE MANAGEMENT OF CONCURRENCY; PROVIDING FOR A SYSTEM FOR THE MANAGEMENT OF CONCURRENCY; PROVIDING FOR THE TERM "XERISCAPE"; PROVIDING FOR XERISCAPE LANDSCAPING PRACTICES; PROVIDING FOR TREE PRESERVATION AND PROTECTION; PROVIDING FOR PROTECTION OF SEA TURTLES DURING NESTING SEASON AND DURING BEACH RENOURISHMENT; PROVIDING FOR REGULATIONS FOR MARINAS AND MULTI -SLIP DOCKING FACILITIES; PROVIDING FOR REGULATIONS FOR BEACH AREAS AND AREAS SEAWARD OF THE COASTAL CONSTRUCTION CONTROL LINE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. 3. Other Business: Noting that numerous complaints have been received by Council members and staff regarding stray cats on the beach. the Village Manager was directed to review options for remedy of this situation. Mr. Weiss reported that he had contacted "Over 50 Productions" pursuant to discussion at the last meeting. He reported that he had advised them that the Village wanted assurance that this video would not be aired any further and that this assurance was critical to any settlement agreement.' 4. Next Meeting Dates: Mayor Stern announced that our next regular Council meeting would be November 20, 1990 at 9:30 a.m. The next special Council meeting will be November 27, 1990 at 5:15 P.m. 1Mr. Boggess excused himself and exited the meeting at this point (5:50 p.m.).
