WHEREAS, Friendship Leasing, LLC, owners of the real estate hereinafter described, having submitted to the City Council a plat of said real estate, being located In Jefferson City, Cole County, Missouri,and more particularly described as follows: All of Lots 2 and 3 of BEASLEY SUBDIVISION as per plat of record in Plat Book 11, page 85, Cole County Recorder's Office, EXCEPT that part of Lot 2 described as follows:BEGINNING at the most northerly corner of said Lot 2; thence S51'54'50"E, along the northeasterly line of said Lot 2, 6.00 feet; thence S38'05'10"W, 130.78 feet to a point on the southwesterly line of said Lot 2; thence northwesterly,along the southwesterly line of said Lot 2,on a curve to the right having a radius of 476.79 feet, an arc distance of 6.27 feet to the most westerly corner of said Lot 2; thence N38'05'1 0"E, along the northwesterly line of said Lot 2, 128.95 feet to the beginning point of this description. Containing 37,422.85 square feet or approximately 0.86 of an acre. • WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the owner of said subdivision, known and referred to as the Plat of Friendship Townhouses Subdivision,that all taxes have been paid,and that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1.That the plat of Friendship Townhouses Subdivision,lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri. SECTION 2. Subject to the following variances to Chapter 33, Subdivision Code (a) That no street frontage is required for Lot 3A; and (b) That Lot 2E is created with less than 35 feet of frontage on a cul-de-sac. SECTION 3. Subject to provisions contained in the Townhome Declaration and Homeowners Association established for Friendship Townhouses Subdivision and other private restrictions as may be recorded with this subdivision plat. SECTION 4. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of Jefferson. • 1 SECTION 5. Two variances to the subdivision regulations are needed for the two parcels to be rcplalicd into 10 individual lots. First,Lot 3A does not have frontage on a public street. Second,all lots except Lot 2L' have less than the required 35 feet of frontage on a cul-de-sac. These requirements are intended to ensure that emergency vehicles have adequalcaccess to individual building lots and to prevent driveways from consuming the entire street frontage. In this case, adequate access exists to the buildings and no additional driveways are proposed. Thus existing nxcess will not be diminished by the lownhome plan and reptat. Setbacks, The proposed buildings set back from all exterior lot lines in excess of the 10 foot minfnunm requirement. Attached lownhomes arc allowed to have it zero setback at the common wall or interior lot line, Parking. Two parking spaces are located in front of each residential unit. A Homeowners Association will maintain the driveways and parking areas and other improvements which benefit all lot owners. Staff Recommendation Staff recommends approval of the Preliminary and Final PUD Plan and Replal, including the two variances, •subject to compliance with the recommendations and technical corrections of the Engineering Division. Jefferson City Planning & Zoning Commission Meeting Engineering Division Staff Report • Thursday, October 13, 2005, 5:15pm Item G.- New Business - Public Hearings Case No. P05047 - Preliminary and Final Plan, and Friendship Townhouses Subdivision Replat, 2423 & 2427 Beasley Court(PUD) COM M F.NTS: The Engineering Division has done a technical review of the site plan /subdivision replat as submitted by Central Missouri Professional Services. The following comments are regarding this review; Regarding infrastructure; Infrastructure is existing, including street, storm sewer, and sanitary sewer. Sidewalk does not currently exist upon the property, nor in the vicinity along any City streets. However, the cul-de-sac of Beasley Court is less than 400 feet in length, so the Subdivision Code does not require sidewalk to be constructed for a cul-de-sac less than 400 feet. Regarding traffic impact; Traffic impact does not change, since no improvements are being made to the property. ENGIN IF RING STAFF POSITION: Support. •
