AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
ZONING 0.81 ACRESAS RS-1 SINGLE FAMILY RESIDENTIAL,FOR PROPERTY ADDRESSED
AS 2606 BRIARWOOD DRIVE, LOCATED IN FAINWOOD SUBDIVSION, JEFFERSON CITY,
COLE COUNTY, MISSOURI.
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have
in all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The following described real estate is zoned as RS-1 Single Family Residential:
Parts of Lots Nos. 1 and 2 of Fainwood Subdivision, 1't Addition, per plat of record
in Plat Book 8,Page 61,Cale County Recorder's Office;said Fainwood Subdivision,
1" Addition, being a subdivision of part of the northeast quarter of the northeast
quarter of Section 15, and part of the northwest quarter of the northwest quarter of
Section 14, all in Township 44 North, Range 12 West; said part of Lots Nos. 1 and
2 being more particularly described as follows: Beginning at a point on the
• southerly line of Lot No. 2,which is 10 feet easterly from the southwesterly corner
thereof;thence northerly parallel with the westerly line of said Lot No.2, to the north
line thereof;thence easterly along the northerly line of Lots Nos. 1 and 2,207.5 feet;
thence in a southerly direction to a point on the southerly line of said Lot No. 1,
which 170 feet easterly from the point of beginning, thence westerly along the
southerly line of Lots Nos. 1 and 2, 170 feet to the POINT OF BEGINNING.
Containing approximately 0.81 acres. Subject to easement and restrictions of
record.
Section 2. This ordinance shall be in full force and effect from and after Its passage and
approval.

COME NOW, the Petitioners, DENNIS AND LINDA FOULK, and pursuant to the
provisions of §71.012, RSMo., hereby petition the City of Jefferson City, for voluntary
annexation into the City of Jefferson City, and In support thereof, state the following:
1. That petition is the ownerof certain property in Cole County, Missouri, said property
being described in the attached exhibit and being hereinafter referred to as "the
Property":
2, This real estate is not now a part of any incorporated municipality.
3. This real estate is compact and contiguous to the existing corporate limlts of the City
of Jefferson, Missouri, or is contiguous and compact to other property petitioned for
annexation.
4. That the petition is the owner in fee of all of the property to be annexed.
WHEREFORE, petition requests that the City of Jefferson City annex the aforesaid
property.

Notification
Letters were mailed to adjoining and affected property owners tuition IS5 feel (both within ilia city and in
unincorporated Cole County). Notification was published in ilia News 'Tribune, as required by city code
and state statute. A sign was also posted on the property.

')*ile subject property is located nt the northwest corner of 13riarwood Drivc and Frog I lollow Road. The
property consists of one lot which is developed with it single-family home. The property to Iho north is
undeveloped and has been petitioned for voluntary annexation with C-2 zoning being requested by ilia
owner. Adjoining ilia property on the cast is Frog I Ulm Road and Wears Creek. Properly to the south
and west is developed with single-family homes but is not in ilia city limits and is unzoned.
Annexation Petition
The voluntary annexation petition submitted by the property owners contains no conditions. This property
will become contiguous to the city limits with the annexation of adjoining property to (lie north (Case No.
P05044). The general area was included as a Priority One area in the City's 1996 Annexation Plan. In
. addition, this land was included its part of the 2002 annexation a0cmpt ofthe"Southwest Area".
