HomeMy Public PortalAboutORD13982 • BILL NO. 2005-112 SPONSORED BY COUNCILMAN pBROWN 2 ORDINANCE NO. /,d 9 d AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 35, ZONING CODE TEXT; SPECIFICALLY LAND USE MATRIX, ACCESSORY BUILDINGS AND STRUCTURES, SPECIFIC USE STANDARDS, DENSITY AND DIMENSIONAL STANDARDS, LOT MEASUREMENT AND EXCEPTIONS, MULTI-FAMILY BUILDING SEPARATION, SETBACKS FOR CLUSTER AND COMPACT HOUSING, AND OFF-STREET PARKING AND LOADING REQUIREMENTS. WHEREAS it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with; NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article 11 Exhibit 35-28, Land Use Matrix, Permitted, Conditional and Special Exception Uses is hereby amended as follows: (1) Exhibit 35-28.1.A Household Living, Add Specific Use Type 1 (Single Family Residential)as a Permitted use in RA-1 and RA-2 districts. • (2) Exhibit 35-28.1.A Household Living, Add Specific Use Type 8 as Permitted in the N-O district. (3) Exhibit 35.28.2.D. Day Care for Adults or Children, Specific Use Types 1 and 4; corrected to agree with definitions; applicable to 6 or fewer children. (4) Exhibit 35-28.3.G. Accessory Buildings, Structures and Uses is hereby amended as follows: (1) To Section 35-40.A. add the following: 8 Detached garages and accessory buildings shall be separated from the principal building by at least 10 feet. (2) Section 35-40.B.3., accessory buildings, structures and uses customarily associated with residential uses is amended as follows: d. Tennis court, swimming pool, garden house, arbor, ornamental gate, barbecue oven,fireplace,gazebo,deck,patio,and similaruses customarily accessory to residential uses. P. Raising and keeping of small animals as pets, in conformance with Chapter 5 of the Code, and provided that such pets shall not be kept on a commercial basis. A fence or wall shall be installed around the perimeter of the development and may consist of either the solid • facades of the storage structures or separate fence or wall,except this requirement shall not apply to the front yard. • (2) Landscaping. A Type B Bufferyard shall be provided along all side and rear property lines,except when abutting an industrial district.All areas on the site not covered by pavement or structures shall be brought to finished grade and planted with turf or other appropriate groundcover(s)and with deciduous and/or coniferous plant materials. Section 35-51.8 Lot Measurements and Exceptions, Subparagraphs 3, 5 and 7 are hereby amended as follows: B. Lot Measurement and Exceptions. 3. Lot Width and Frontage. a. Lot width. Lot width is measured as the shortest distance between • opposite side lot lines at the front building setback line. 5. Setbacks. C. Exceptions and Permitted Encroachments. The following features may encroach into required setbacks as described below: (11) Accessory structures and buildings shall be located not less than five feet from the rear property line, except that a garage with an alley entrance shall be located at least ten feet from the alley line, Accessory structures and buildings located at least 60 feet from the front lot line shall be located not less than five feet from the side property line. (15) Open unenclosed Porches, by not more than 10 feet Into the front yard. 7, Flag Lots. Flag lots shall be allowed in all Residential zoning districts in accordance with the standards of this Ordinance provided: a, the width of the pole of the flag lot Is not less than 35 feet the mirtimnrn b, the pole of the flag lot abuts a public street; and C. the driveway Is paved in conformance with Section 35-58 of this Ordinance and a space is Provided for vehicles to turn around and drive out forward when leaving the residence. • Section 6. Section 35-53.B.Multi-Family Residential Design Standards is hereby amended as follows; B. Principal Buildings/Lot. Multi-family residential uses may have more than one building located on the lot provided that the minimum distance between multi-family buildings on the same lot shall be 15 feet Plus an additional 5 feet for each story in the tallest building when the tallest building has two or more stories.
