CITY OF MEDINA
RESOLUTION NO.2012-67
RESOLUTION VACATING THAT SEGMENT OF THE NAVAJO ROAD E.
RIGHT-OF-WAY WITHIN THE ENCLAVE AT MEDINA PLAT
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, the City has approved the plat of The Enclave at Brockton which dedicates
certain right-of-way for a public street called Wild Flower Trail; and
WHEREAS, the City has previously approved the plat of The Enclave at Medina, which is
west of The Enclave at Brockton and which dedicated certain right-of-way called Navajo Road E.;
and
WHEREAS, the Navajo Road E. right-of-way within the plat of The Enclave at Medina
allowed for a potential road connection to the east; and
WHEREAS, the subsequent dedication of the Wild Flower Trail right-of-way provides an
alternative road connection; and
WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing for
October 2, 2012 to consider the proposed vacation of the Navajo Road E. right-of-way dedicated
within the plat of The Encalve at Medina; and
WHEREAS, notice of the public hearing was posted, published in the official newspaper
and mailed to the owners of affected properties, all in accordance with law; and
WHEREAS, the City held the public hearing on the proposed vacation on October 2, 2012,
at which hearing all interested parties were heard; and
WHEREAS, following the public hearing, the City determined that the vacation of the
Navajo Road E. with the plat of The Enclave at Medina is in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina,
Minnesota as follows:

1. The City hereby declares that the Navajo Road E. right-of-way dedicated on plat of
The Enclave at Medina, Hennepin County, Minnesota is hereby vacated subject to
recording of the plat of The Enclave at Brockton.
2. The city administrator or his designee is authorized and directed to prepare and
present to the Hennepin County auditor a notice that the City has completed these
vacation proceedings and record with Hennepin County recorder the vacation of the
right-of-way only after the filing of plat of The Enclave at Brockton.

The motion for the adoption of the foregoing resolution was duly seconded by member Martinson
and upon vote being taken thereon, the following voted in favor thereof:
Crosby, Martinson, Pederson, Siitari, Weir
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
