HomeMy Public PortalAbout1990-11-20 Regular Meeting57 COUNCIL MINUTES NOVEMBER 20, 1990 - REGULAR MEETING The regular monthly meeting of the Bal Harbour Village Council was held on Tuesday, November 20, 1990 at 9:30 a.m. in the Council Chambers at Village Hall. The meeting was called to order at 9:30 a.m. by Mayor Estelle Stern and the roll was called. Those present were: Also present: Mayor Estelle Stern Assistant Mayor Matthew B. Blank Councilman James E. Boggess Councilman Andrew R. Hirschl Village Manager Carole S. Morris Deputy Village Attorney Steven Helfman Administrative Assistant Teresa M. Smith Absent: Councilman Sol M. Taplin As a quorum was found to be present, the meeting commenced. 2. Approval of Minutes: A motion was offered by Mr. Boggess and seconded by Mr. Blank to waive the reading and approve the minutes of the October 16, 1990 Regular Meeting as submitted. There being no changes or corrections, the motion carried unanimously (4-0) and the minutes were approved as submitted. A motion was offered by Mr. Boggess and seconded by Dr. Hirschl to waive the reading and approve the minutes of the October 16, 1990 Special Meeting as submitted. There being no changes or corrections, the motion carried unanimously (4-0) and the minutes were approved as submitted. A motion was offered by Mr. Boggess and seconded by Mr. Blank to waive the reading and approve the minutes of the October 30, 1990 Special Meeting as submitted. There being no changes or corrections, the motion carried unanimously (4-0) and the minutes were approved as submitted. A motion was offered by Dr. Hirschl and seconded by Mr. Boggess to waive the reading and approve the minutes of the November 13, 1990 Special Meeting as submitted. There being no changes or corrections, the motion carried unanimously (4-0) and the minutes were approved as submitted. 3. Presentations: None 4. Ordinance - Second Reading - Public Hearing: An ordinance was presented for second reading and read by title amending Section 10-1, 10-7 and 10-8 of the Bal Harbour Village Code and Ordinance 346 modifying the definition of trash, defining vegetation, prohibiting disposal of trash other than vegetation in designated disposal areas and providing reasonable penalties therefor. Mayor Stern opened a Public Hearing to hear comments and there being none, closed the Public Hearing. A motion to approve this ordinance on second reading was offered by Dr. Hirschl and seconded by Mr. Blank. There being no further discussion, the motion carried unanimously (4-0) and this ordinance was approved becoming ORDINANCE NO. 357 ORDINANCE OF BAL HARBOUR VILLAGE AMENDING SECTION 10-1, 10-7, AND 10-8 OF THE BAL HARBOUR VILLAGE CODE AND ORDINANCE 346 ADOPTED MARCH 20, 1990; MODIFYING THE DEFINITION OF TRASH; DEFINING VEGETATION; PROHIBITING DISPOSAL OF TRASH OTHER THAN VEGETATION IN DESIGNATED DISPOSAL AREAS; PROVIDING FOR REASONABLE PENALTIES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. 6. Ordinances - First Reading: None. 7. Resolutions: - None. 8. Reports and Recommendations: A. Mayor and Council - None B. Village Attorney - Mr. Helfman advised Council of new procedures required by Florida State Statutes to be addressed by municipalities regarding vacancies occurring during the election process. The appropriate ordinances required will be drafted by the Village Manager and Village Attorney and presented to Council for consideration at a later date. Additionally, Mr. Helfman informed Council that his office has advised Over 50 Productions that Bal Harbour Village will remit no further monies to them and if they pursue this matter, we will institute legal action to remove the commercial from the air entirely. C. Village Manager 1. a. and b. Mrs. Morris requested Council's approval to purchase an emergency generator and manual transfer switch for Village Hall. After some discussion, it was Council's decision to defer this matter and directed Mrs. Morris to obtain proposals for November 20, 1990 - Regular Meeting 2 59 a permanent generator. c. and d. As a part of the recent Village Hall renovation, and in view of the present condition of the ceiling tiles and poor lighting throughout Village Hall, Mrs. Morris requested authorization for replacement and repair thereof. Council authorized Frank Stull Interiors, Inc., low bidder at a price of $14,000 to replace the ceiling tiles and Rice Electric, the low bidder at a price of $6,500 to install new lighting in Village Hall. 2. Mrs. Morris reminded Council that Special Masters are required as a part of the newly -established code enforcement procedures and presented the names of three Village residents for approval. After brief discussion, a motion was offered by Dr. Hirschl and seconded by Mr. Blank to ratify John D. Arenstam, Benjamin Oremland and Darcee S. Siegel as Special Masters for Bal Harbour Village. There being no further discussion, the motion carried unanimously (4-0). Mrs. Morris then requested Council approve a change order in the sewer rehabilitation project in the amount of $6,394.57 which provides for replacement of the discharge pipe. A motion was offered by Mr. Boggess and seconded by Dr. Hirschl to approve this change order. There being no further discussion, the motion carried unanimously (4-0). 9. Other Business - none. 10. Adjourn: There being no further business to come before the Council, a motion was offered by Mr. Boggess and seconded by Dr. Hirschl to adjourn.
