I request to inspect certain public records related to the Town of Gulf Stream Florida. While I am not obligated to explain why I want to inspect these records, I tell you it is for the purpose of informing myself of the historic and current workings of the Town of Gulf Stream and its associated entities, vendors, consultants, advisers, contractors and agents. The records I wish to inspect may also be material to current, anticipated or presently unforeseen legal action. In addition, inspection of these records may be essential to my ability to make informed comments in an upcoming public hearing. The production of any and all responsive records is therefore urgent and must be acted upon in compliance with Florida Statutes and established case law as soon as possible. Before making this public record request, I first searched online and in the public records portion of your agency's website hoping I could locate the public records I seek without having to write you directly. Unfortunately I cannot find the records I request to inspect. Therefore I am writing you now and requesting you make every effort as required by law to produce these public records without delay. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. I hereby reserve all rights granted to me under the Florida Constitution and Florida Statutes. I ask that you take the following action: • Read this entire request carefully and respond accordingly. • If you are not the custodian of the public records described herein please determine who that person is and notify me immediately in order that I may make this request to the appropriate person without delay. • Reference Florida Statutes and appropriate case law when responding to this record request. • Do NOT produce any records other than records responsive to this request. • Identify by name the person or persons responding to this request if that person is not the Custodian of Records for your agency as required by 119.070)(b). " Respond to this public record request in a singular manner and do not combine this request with any other public record requests when responding to this request. " Once you have determined that you do or don't have any records in your custody responsive to this request, immediately act to obtain any responsive records that may be in the custody of your contractor(s) or other parties. " Provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. As background to this request I want to explain to you that I believe I recall an official occasion held in Town Hall during which the Town of Gulf Stream* used the phrase FLIPPING THE BIRD or GIVING THE MIDDLE FINGER or some similar phrase whose meaning is not to be confused with the act of rotating an avian creature more than 90 degrees or offering one's middle digit to another but the more commonly understood meaning of showing anger at another person by reference of an intimate sexual act. I know the utterance of such a phrase seems rude, unprofessional, preposterous and perhaps in violation of the Town's Decorum Policy ( at least it does to me, if not the Town) but I do think such a record exists. I request to inspect the most recent public record that records the utterance of the phrase FLIPPING THE BIRD or GIVING THE MIDDLE FINGER or some similar phrase used by the Town of Gulf Stream* when addressing a resident of the Town of Gulf Stream. I ask you to take note of �119.07(1)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual and entity in possession of records that may be responsive to this public records request, including individuals and entities under contract with your agency, to preserve and produce all responsive records on an immediate basis. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by �119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by �119.07(1)(f) of the Florida Statutes. Produce for my inspection all responsive records and ONLY redact that portion of the record that you consider exempt. To be clear, if you consider an entire record to be exempt, produce that record in its entirety with all portions redacted that you consider exempt. I specifically ask you to do this in order that I may inspect fully redacted records for the purpose of challenging a particular redaction or establishing a reference for a future request of a record that is only temporarily exempt, as in the case of a public record that was prepared by an agency attorney exclusively for litigation and is only exempt from disclosure until the conclusion of the litigation. If the public records being sought are maintained by your agency or contactors for your agency, in an electronic format please produce the records in the original electronic format in which they were created or received. See §119.01(2)(f), Florida Statutes. Again I ask that you provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. Take note of §119.07(4)(a)3.(d) Florida Statues and if you anticipate that any records exist, the production for inspection of which will require extensive use of information technologies or extensive staff time or both in excess of 15 minutes, then please provide those records that can be produced within the first 15 minutes and advise me of the cost you anticipate to be incurred by your agency for the remaining records prior to incurring this cost. Please do not incur any costs on my behalf without first obtaining my written authorization to proceed. If you produce only a portion of all existing responsive records, please tell me that your response includes only a portion of all existing records responsive to this request. If you anticipate the need to incur any costs that I would be statutorily required to pay in order to inspect these public records which would exceed $1.00 please notify me in advance of your incurring that cost with a written estimate of the total cost. Please be sure to itemize any estimates so as to indicate the total number of pages and/or records, as well as to distinguish the cost of labor and materials. Again, please do not incur any costs on my behalf without first obtaining my written authorization to proceed. The term public records, as used herein, has the same meaning and scope as the definition of Public records adopted by the Florida Legislature as Statutes Chapter 119. A record that does not exist because of its disposition requires the creation of a disposition record. In all instances where you determine a record does not exist please determine if the record once existed and in its replacement provide the disposition record for my inspection. I have thought about it some more and remember more details. I now supplement that request with the following information to the best of my recollection: I believe the phrase was uttered by the Town Attorney, Mr. Randolph. I believe Mr. Randolph said it in Town Hall. I believe Mr. Randolph said it during an official hearing. I believe the hearing was held in mid May 2013. I hope this request is now sufficiently clear. (2 hours @ 28.91= 57.84) =Deposit Due: $57.84 in cash or check. May I remind you that you have not yet produced or apparently searched for any records responsive records and the 15 minutes you refer to is the time recognized by the courts as the reasonable amount of time required of an agency to be spent producing a public record before charging for the cost of administrative support.Your email of August 30th does not mention that you looked and couldn't find any records. Instead it merely asks for clarification in order for you to expedite the search. Then in your email of August 31 you claim to have already used up 15 minutes on this request. I note that the link you provided to me leads to the record you created on your website on 8/22/2016 3:22:58 PM and modified on 8/31/2016 12:14:26 PM in response to my record request. Apparently instead of responding immediately to my request by looking for responsive records, you instead spent time creating a record of the request with subsequent modifications. I do not consider time spent by you creating a record of my request to be the same as responding to my request. Considering that I have clarified for you the location, date and circumstance of the incident the record memorializes are you certain that it will require two hours to find? Please confirm whether you still believe you need this much time to produce the responsive record and that you have indeed already consumed 15 minutes searching. May I hear from you soon? I am at a loss to understand how you reached the conclusions you've come to since I don't find any basis in my text that would lead me to reach those same conclusions. I respectfully request you allow me to explain. The phrase "may I remind you" is an expression I sometimes use when I want to make a polite request to inform someone of something they may already know but have not verbally acknowledged. I use this instead of "let me tell you a thing or two" which I often heard growing up but find too impolite to use myself. When I use the word "apparently" I mean that something that may or may not be true seems true to me. But rather than omitting it from the statement I wish to make, which would then sound more emphatic and perhaps belligerent, I prefer to inform the reader through the use of the word "apparently" that the statement is my understanding of the matter and I expect it may be subject to correction when and if more information is forthcoming. When I used the phrase "you claim" in my email, I was qualifying my understanding of your statement by suggesting your statement was not accompanied by any additional information to support it. I can't see how these common words and phrases were sufficient for you to feel belittled, insulted and your work ethic and intelligence challenged. Hence my amazement at the conclusions put forth in your email. I have no idea what your work ethic is, nor do I care, but as a tax paying resident I appreciate your assurance that it is something you take pride in. I also have no intention of reminding you how to do your work but I reserve the right to question your estimate which, given the amount of clarification I provided, seems excessively high. Perhaps if you consulted with the Custodian of Records, who I believe was in attendance when Mr. Randolph uttered the profanity that is the subject of my request, she could direct you straight to the record. I understand you are only recently hired but given the Town's poorly organized record retrieval system is seems unfair that you should be expected to find records without her assistance. It also seems unfair that I should be charged excessively when a word from her could potentially reduce your search time. I am informing the Custodian of this suggestion by copy of this email. You say (I would normally have used the word "claim" here instead of the word "say" but in deference to your apparent interpretation of its meaning, I will not) that "knowing that I've already spent more than 15 minutes, I know it will require approximately two hours of my time." I don't know how you jumped to that estimate but I will send the money and we will see if your estimate is accurate. It is also not obvious to me that by your asking for clarification it automatically means you have already searched for the record. The Custodian of Records has asked me for clarification in the past without having searched; I assumed you operate the same as she. I appreciate you agreeing with me that you "do not consider time spent... creating a record is the same as responding to a record request." In this instance you and I are at odds with the opinion's of Mr. Thrasher, Ms. Taylor and some Commissioners, as expressed in the media, in Law Review, in testimony under oath and before legislative committee that the creation of the online record archive is in their opinion a big part of the Town's efforts to respond to public records. Perhaps you could share your contrary opinion with them. I also appreciate that you do not play games or use a play on words. That will be a refreshing change from some of my previous experiences. Finally, I want you to understand that I take my right to inspect public records and your obligation to produce them very seriously. If there was any misunderstanding of my communications because they were insufficiently crafted as to cause your negative perception of their "tone" and negative interpretation of their phrases and words, I apologize and I will make a special effort to carefully craft my future communications to you in order to hopefully avoid such misunderstandings. So when you say I "apparently spent time creating a record instead of responding" is again insulting to my intelligence and work ethic. Not that I need or have to explain my work, I will, so that you will know in the future, my work ethic has a very high standard. When you sent your first request on August 22, 2016, I began searching in the "most recent" minutes of a Town Commission meeting since that is what you requested. After I had spent 15 minutes doing that and saw that it wasn't going to be as easy as opening up the "most recent" minutes, I sent the letter asking you to clarify a date. You then answered and sent me a clarification on the date. Already having spent 15 minutes, I took more time to look through the Town Minutes of the "mid-May, 2013 meeting. Not seeing anything in those minutes pertaining to your request, the Town will now have to go to greater lengths to find what you are requesting, and yes, knowing that I've already spent more than 15 minutes, I know it will require approximately two hours of my time. I know the utterance of such a phrase seems rude, unprofessional, preposterous and perhaps in violation of the Town's Decorum Policy (at least it does to me, if not the Town) but I do think such a record exists. I request to inspect the most recent public record that records the utterance of the phrase FLIPPING THE BIRD or GIVING THE MIDDLE FINGER or some similar phrase used by the Town of Gulf Stream * when addressing a resident of the Town of Gulf Stream.
