A meeting of the Town Commission of the Town of Gulf Stream, Florida was held at the Town Commission room in the Gulf Stream Golf Club on Tuesday, December 23rd at 11.30 a.m. Commisioners present: Mayor L.Seton Lindsay, Clerk Wm.J. Bauer. Also invited Attorney C.Y.Byrd and Vice Mayor Elect Wm.T.Jebb. The selection of Mr. Wm.T.Jebb to serve as Vice Mayor until the next election was confirmed and Mr. Jebb was sworn into office by Mr. Byrd. Orlinance #100 granting to Florida Power & Light Company a franchise to sell electa2c current was read fort he second time and approved by all the Commissioners. Mr. C. Y. Byrd discussed the election of officers. There being no further business to come before themeeting it adjourned. I,,ayor Ln )Cl t Town Cleft MINUTES OF THE REGULAR MEETING OF THE TOWN COMMISSION, GULF STREAM, FLORIDA, DECEMBER 239 1947. The regular meeting of the Towh Commission of the Town of Gulf Stream, Florida, was held in the Town Commission Room in the Gulf Stream Golf Club Building in the Town of Gulf Stream, Florida, at eleven o'clock A.M. on December 23, 1947, with Mayor - Commission Lindsay and Clerk- Commission Bauer, present. Mayor Lindsay explained to the Commission that at a special meeting of the Town Commission held on November 26, 1947, Commission W.S. Webb tendered his resignation, and that said resignation was accepted by unanimous vote of the Commission. It was brought to the attention of the Commission that in the absence of the Mayor, the Vice -Mayor automatically become Mayor, and on motion duly made, seconded and carried, Commissioner Lindsay was hamed and designated as Mayor - Commissioner of the Town of Gulf Stream to serve as such until the next regular election of the Commission to be held in March, 1949. Commissioner Bauer advised the Commission that William T. Jebb, a duly registered voter and large property owner of the Town had consented and agreed to accept the appointment as Vice - Mayor- Commissioner of the Town, and that Mr. Jebb was present and ready to accept the appointment, thereupon the following resolu- tion was offered by Commissioner Bauer: Whereas, Commissioner W.S. Webb has tendered his written resignation as Mayor- Commissioner of the Town of Gulf Stream; and Whereas, said resignation has been accepted by the unan- imous vote of the Commission; -2- Now, therefore, BE IT RESOLVED by the Town Commissioners of the Town of Gulf Stream, Florida. 1. That William T. Jebb be and he is hereby duly appointed as Vice -Mayor Commissioner of the Town of Gulf Stream to serve in such capacity, to fill the unexpired term of Commissioner W.S. Webb, who has resigned, and to hold said office until the election of his successor, or until such time as his successor has been duly elected or appointed, and qualified. On motion made by Commissioner Bauer, seconded by Commissioner Lindsay, and on roll call, the resolution was juanimous- ly adopted. Thereupon Commissioner Jebb was requested to take the oath of office as Town Commissioner, which oath of office was administered to him by C.Y. Byrd, a duly qualified Notary Public authorized to administer oaths. The newly appointed Commissioner Jebb thanked the Commission for his appointment and advised that he would serve as a Commissioner of the Town to the best of his ability. The minutes of the Town Commission of the Town of Gulf Stream of the meetings held on November 22, 1947 and November 26, 1947 were read in full, and there being no amendments, alterations or corrections, on motion by Commissioner Jebb, seconded by Commissioner Bauer, said minutes were approved as read without alterations or corrections. Commissioners Jebb, Bauer and Lindsay voted in favor of the motion. Town Clerk Bauer presented to the Commission a certificate certifying that Ordinance No. 100, the same being IrAn Ordinance Granting to Florida Power and Light Company, its successors and assigns, and electric franchise, and imposing provisions and conditions relating thereto« has been duly posted at the front door of the -3- Town Hall on the bulletin since the date of its first reading on November 22, 1947, and that said Ordinance had been continuously posted on said board up to this date. On motion made by Commissioner Jebb, seconded by Commissioner Bauer, Tom Clerk Bauer +s certificate that said Ordinance had been duly posted for thirty days was ordered noted in the minutes, which motion was carried on the following vote: those voting in favor of the motion were; Commissioners Jebb, Bauer and Lindsay. Commissioner Bauer then presented to the Commission 6or its consideration, aid on second reading, the following Ordinance: "Ordinance No. 100 "An Ordinance Granting to Florida Power and Light Company, its Successors and Assigns, and Electric Franchise, and Imposing Provisions and Conditions Relating thereto'? which Ordinance was read in full and on motion by Commissioner Bauer, seconded by Commissioner Jebb, and on roll call said Ordinance was adopted as havinZ been read in full on its second reading and final adoption; Commissioners Bauer, Jebb and Lindsay voted for the motion adopting said Ordinance and thereupon Mayor Lindsay stated that the motion was unanimously carried, and that Ordinan ce No 100 was declared to be adopted and passed by unanimous vote of the Commi- ssion, and the same was ordered filed in the Ordinance Book of the Town. On motion duly made by Commissioner Jebb, seconded by Commissioner Bauer, the three Commissioners of the Town were authorized and in- structed to sign four complete copies of said Ordinance No 100 and to place the Town Seal upon said Town Ordinance and deliver the same to Mr. Senior, Manager of the Florida Power and Light Company, which motion was unanimously adopted by the Commission. -4- Mayor Lindsay instructed Town Clerk Bauer to sign such certificates as Mr. Senior desires to have executed, in order that his Company may have a complete record or the iUnutes showing the adoption, reading, posting and passage of said Ordinance No. 100. Commissioner Jebb before signing said Ordinance, requested Town Attorney Byrd to explain each provision of the Ordinance to him, section by section, and after considerable discussion, (Mr. Jebb being a new Commissioner) the entire matter was properly ex- plained to him, and each provision thereof met with his approval. Mayor Lindsay brought to the attention of the Commission the situation with which the inhabitants of the Town of Gulf Stream were confronted with, with reference to water supply. Town Attorney Byrd was instructed to cintinue his negotiations with the City of Delray Beach, and also with the City of Boynton Beach,in an effort to work out a satisfactory arrangement whereby a long -term contract could be entered into with either of said municipalities, whereby the Town of Gulf Stream could buy water at a mastor meter, and resell it to its inhabitants through its distribution system. Town Attorney Byrd stated that it would be advisable to let this entire matter stand in aboym ce until such time as the new City Council- -which has recently been elected in Delray Beach, had taken office and adjusted themselves to their new duties. Town Clerk Bauer suggested to the Commission that each member of the Commission be on the look out for a good man to take over the job of Superintendent of Public Works in the Town, and it was suggested that Mr. Cook of Boynton Beach be interviewed, as it was understood he may be looking for a new job within the near future. -5- Commissioner Jebb stated that Mr. Riley, and other interested tax payers and citizens of the Town, were most interested in holding a Town meeting whereby all of the tax payers and citizens would be given an opportunity to express themselves as to certain public utilities which should be considered in the Town, such as garbage collections, water, also street cleanup, maintenance and repairs. It was decided that such a meeting would be held either the latter part of January, or sometime during the month of February, Mayor Lindsay agreeing to set a date which would be convenient for all parties concerned. Mayor Lindsay requested the Town Attorney to advise the Commission when the next general election of the Town would be held as he was of the dpinion said election would be held in March,1948. Town Attorney read the Charter Act of town of Gulf Stream which was adopted by the legislature of the Stlate of Florida in 1943, and advised the Commission Ghat the next election would be held in March,1949 as prescribed by the Charter Act. Commissioner Bauer moved that the Commission meet at regular session at 11:00 o'clock A.11. on December 23, 1947, for the purpose of taking up and having the Proposed Ordinance read a second time and adopted, provided there were no objections from any of the tax payers, voters or residents of the Town of Qzlf Stream.
